DECISION
The petitioner requested a special permit from the Board of Appeals to allow one
additional sign at Papa Gino's Restaurant of 94 0 Main St.",
t. ;ute �8); S. Yarmouth,
n on Assessor Mass., which is in excess of zoning by-law. Property shows map
#35-W14, being in the Highway Commercial District.
Members of Board of Appeals present: Robert Nichols, Donald Henderson, David Oman,
Thomas George, Joseph Pandiscio.
It appearing that notice of said hearing has been given by sending notice thereof
to the petitioner and all those owners of property deemed by the Board to be affected
thereby and that public notice of such hearing having been given by publication in the
Yarmouth Sun on 10/28/81 and 11/4/81, the hearing was opened and held on the date first
above written.
The following appeared in favor of the petition: Mr. Spinanzola, from Papa Gino's;
Mr. Ginzsburg, from Alco Sign Co.
The following appeared in opposition: None.
Reasons for decision:
The Board found that the positioning of the building on the lot created a unique-
ness which could cause a traffic hazard if a sign was such that it interfered with
driver visibility. One way to correct any problem would be to eliminate the free
standing sign now existing, which the petitioner is willing to do. There is a hardship
in that the line of sight creates a difficulty for drivers to formulate a plan for
turning into the parking lot in sufficient time to do so without hazard.
The Board voted to grant a sign on the south gable, which sign is to say "Papa
Gino's", and is not to exceed 11' out to out on the width, and a maximum of 2' out to
out on the height, and the petitioner is to remove the pylon sign and keep the logo
on the south side of the building.
Members of Board voting: Donald Henderson, Robert Nichols, David Oman, Thomas George,
Joseph Pandiscio. 4 voted in favor to grant request, 1 voted not in favor.
Therefore the petition is granted as stated above.
No permit issued until 20 days from the date of filing the decision with the Town Clerk.
