M. O'REILLY AND ASSOCIATES, INC. is submitting the attached Notice of Intent for the above -referenced property. The Notice of Intent is for the additions/removals to the existing dwelling and mitigation/landscaping. Please refer to the Proposed Site Plan and Landscape & Mitigation Plan (BlueFlax Design) for details. Existing Conditions: The site is located at the Southern end of Glenwood Street with frontage on Lewis Bay. The property is served by an existing 5-bedroom dwelling, existing shell driveway, and existing raised septic system. The dwelling is further served by multiple steps, decks, a hot tub, multiple stone/brick walkways/patios and sparse lawn. The southernmost point of the property is armored with a 5-6 Feet tall stone revetment, installed in the late 1980's. The top of the revetment is considered a Coastal Bank based on MA DEP Policy #92-1. At the toe of the Bank on the West and East is a Coastal Beach. On the North-West side of the property there is a Salt Pond and a Salt Marsh, the latter extending onto the locus property. The entire site is located within the FEMA Velocity Zone, EL= 13, also known as Land Subject to Coastal Storm Flowage(LSCSF). Paul and Nancy Cruz purchased the property in June, 2025 and inherited a pre existing enforcement order by Yarmouth Conservation for unpermitted landscaping. PROPOSED CONDITIONS: On the South side of the existing dwelling, an existing landing and stairs, brick patio and slate walkways are to be removed and replaced with a new deck and single stair. On the West side of the house an existing hot tub/decking are to be removed, new gas fired generator/ac unit to be installed and proposed expansion of the existing deck. 1573 MAIN STREET, P.O. On the far North side of the property there is a proposed 8'x12' shed. LANDSCAPING & MITIGATION: The Landscape & Mitigation Plan by BlueFlax Design includes approximately 794 SF of invasive species management along the Salt Marsh on the North-West side of the property and approximately 966 SF of lawn removal and re vegetation with native species in the same area. The native plantings will create a wider vegetated buffer strip adjacent to the Salt Marsh. The landscape proposal includes removal of lawn area for the entire site and replacement with micro clover/fescue seed mix. On the south side of the property approximately 17.5 Cubic Yards of sand nourishment is proposed with native beach grass plantings within and above the stone revetment. Please refer to the Landscape Mitigation Plan for further details and notes for proposals. The 794 SF of invasive species removal and 966 SF of lawn removal and native plantings shall serve as mitigation for the current proposals and acts to satisfy the Enforcement Order on the subject property. Construction: Prior to start of work, all required permits shall be granted including a building permit from Yarmouth Building Department and the Order of Conditions, to be issued by Yarmouth Conservation. Prior to start of the work the contractor shall complete the start of work procedure as outlined in the Conservation Order and install the straw wattle silt barrier as shown on the site plan. Access and staging will be located in the driveway area to complete removals of the hot tub, South & North side landings & entry stairs. A mini excavator and small bobcat loader shall be used for structure removal, excavation for new deck footings, shed footings, installation of roof runoff drainage and drainage for rinse station. The dwelling will be fitted with gutters, downspouts and underground drainage for all roof runoff. Currently there is only one downspout and stormwater is dispersed directly on the existing lawn. Please refer to the Proposed Site Plan for notes and details for storm run off. Performance Standard for Wetland Resources: Coastal Bank; 310 CMR 10:30 (6) & Yarmouth Section 4.05(B): No current site proposals will negatively impact the stability of the Coastal Bank (stone revetment). The proposed nourishment and beach grass planting will enhance the stability of the Bank. Salt Marsh; 310 CMR 10:32(3) & Yarmouth Section 4.06, 3a.: No portion of the project is proposed within the Salt Marsh. The invasive species removal and mitigation plantings around the Salt Marsh shall enhance the vegetated buffer giving the Salt Marsh further protection increasing its productivity. LSCSF & Yarmouth Section 4.10(3): The existing site will be maintained as in the removal or placement of any fill which will not impact storm flowage and/or displace flood waters. The proposed decks and shed shall be anchored to footings/helical anchors as required by MA Building Code for construction in a Velocity Zone. Cruz Notice of Intent December 24, 2025 4 Glenwood Street, West Yarmouth, MA 1MO-9831 CONCLUSIONS: The proposed project includes minor changes to the site & dwelling, including the removal of approximately 42 SF of structures and/or impervious areas, adds roof runoff drainage, sand nourishment, beach grass plantings, mitigation plantings and invasive species removal. The positive changes and steps to satisfy the pre existing Enforcement Order can allow the Yarmouth Conservation Commission to approve the project and issue an Order of Conditions.
