Dear Commission Members:
On behalf of our client, Derek Johnson, this letter serves as a request for a Certificate of Compliance for
the Amended Order of Conditions referenced above, issued on May 29, 2020.
On December 10, 2025 I inspected the property to determine if the project had been completed in
accordance with the Amended Order of Conditions and approved plans. I found the existing building,
septic system and hardscaping to be in substantial compliance with the following exceptions:
- The locations of the AC units and rinse station on the east end of the building were switched.
- There is an elevated generator on the east side of the property and an additional elevated AC unit
on the west end of the building. These items as well as the existing dwelling, septic system and
hardscaping are as shown on the attached Certified Plot Plan.
- An existing cherry tree on the south side of the driveway has been removed. The proposed
plantings (4 hydrangea) at the east end. of the driveway were not completed.
- Two downspouts from the rear porch roof are not connected to drywells.
- The mitigation plantings have been completed. However, some of them are barely visible and
should be adequately protected to prevent accidental damage by landscaping activity and wildlife.

B. Submittal Requirements
Requests for Certificates of Compliance should be directed to the issuing authority that issued the final
Order of Conditions (OOC). If the project received an OOC from the Conservation Commission, submit
this request to that Commission. If the project was issued a Superseding Order of Conditions or was the
subject of an Adjudicatory Hearing Final Decision, submit this request to the appropriate DEP Regional
