Certificate of Compliance
General Information:
•All filings must be made on Town of Yarmouth forms.
•All applications must be submitted two weeks prior to the next scheduled Conservation
Commission meeting. Refer to Meeting Schedule.
•Failure to follow the Administrative Checklist shall result in an Administrative Incomplete
Application and will not be scheduled for a Public Hearing.
•Contact the Conservation Office if you need assistance.

Hardcopy of the COC application mailed to or dropped off at the Conservation
office in Town Hall.
Signed statement from an Engineer or similar professional to who prepared the
approved plan stating the date of a recent site inspection and certifying compliance
with the permit and outlining departures from the approved plan, if any exist.
As-Built plan – *Refer to issued Order of Conditions: Special Conditions to
determine if required*.

Dear Ms. DiRienzo and Members of the Yarmouth Conservation Commission,
BSC Group, Inc. (BSC) is filing this Request for a Certificate of Compliance (RCOC) on behalf of Channel Point LLC
(the applicant) for the project at 2 Channel Point Drive, Yarmouth, Massachusetts (the Site). The Order of Conditions
(OOC SE 083-2270) was issued on March 5th, 2021 and referenced a plan titled “Plan to Accompany a Notice of Intent”
dated 2/25/2021. An OOC extension was issued for the project on 5/6/2024 and the order is therefore valid until
5/6/2027. The approved project is for bank stabilization.
This project was undertaken because the bank was experiencing erosion. As part of a previous filing with Yarmouth
Conservation, the homeowner was required to perform invasive species management on the coastal bank and planted
some native species. The invasive species on the bank were treated and removed. This destabilized some areas on
the bank, allowing erosion to occur.
This prompted the homeowner to file the NOI in 2021 to stabilize the bank. This work was done by bringing in 6 cy of
compatible material over an area of ±854 sf on the bank. This area was then graded to a slope of ~3:1 and then planted
with American beachgrass (Ammophila breviligulata) and Carolina rose (Rosa Carolina) to stabilize the bank.
A RCOC was submitted back to Yarmouth Conservation back on 10/17/2023, but that request was denied on
11/20/2023 because bare areas on the bank remained. The homeowner complied with the instructions on the denial
letter. The silt fence was removed where possible without impacting vegetation. The silt socks were pulled back and
repaired. The homeowner has re-planted the bare areas on the bank a second time (see photo pages). BSC visited
the Site in September 2025 to inspect the bank. A majority of the bank is vegetated and stable but a few small bare
areas still remain. At this point, the homeowner has tried to plant the bank two times over the life of this OOC and
would like to close out the permit.
This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of
Yarmouth Wetlands Protection By-law. If you have any questions or need additional information, please contact our
