Dear Commission Members,
On behalf of our client, Irene Holmes, J. M. O'REILLY AND ASSOCIATES, INC. respectfully
requests an Amendment to the Order of Conditions for this project due to the changes made to
the pathway layout from the approved plan of record.
The changes to the plan include the following:
• The elevated Stairway and Landing did not obtain the necessary variances from the
Yarmouth Zoning Board of Appeals, since the stairway was viewed as a structure and
relief was needed for the 12-foot wide panhandle.
• An At -Grade Pathway is now proposed down the slope and onto the Pond. The pathway
will include a single handrail. The handrail will consist of a 44 post and 2x4 rail.
• The pathway at the bottom of the slope will still be re -aligned with the panhandle. The
width of the pathway to the Pond will remain the same as the current pathway.
As outlined in the original Notice of Intent, the homeowner is looking to gain access to the Pond
and the existing footpath is becoming too much of a safety concern. The elevated stairway and
landing provided the best access as it was both safe and resulted in minimal impact on the
slope.
The homeowner is still looking to provide a more secure pathway to the Pond. The proposal
now calls for the pathway to be improved with at -grade timber steps. The steps will be 4-feet
wide, like the previous stairway, and will be dug into the ground. Gravel is being added to each
step to assist in drainage and mitigation of scour. No trees will need to be removed for the at
grade pathway. Attached for your use is the revised Proposed Site Plan -Pathway & Steps,
revised December 30, 2025.

The Order of Conditions was issued on August 27, 2025 and has not been recorded.

In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40,
you are hereby notified of the following:
A. The name of the applicant is Irene Holmes
B. The applicant has filed a Reauest to Amend an Order of Conditions with the Yarmouth
Conservation Commission, seeking permission to remove, fill, dredge or alter an Area Subject to
Protection under the Wetlands Protection Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland
By -Law,, Chapter 143),

D. Proposed work is to improve the pathway by installing at grade timber steps on the existing
