Dear Mr. Grier;
On this date, I inspected the oil talk that was removed from the grorud at this property with no
apparent holes or contamination ofthe soil in the area ofthe tank. This tank had been previously
abaudoned in place, cleaned out and soil satples taken showing no contaminationAs ofthis
date, this tank does not exist on this property.

Dear Mr. Grier.
The Health Department has reviewed the process taken to remove the 275 gallon underground oil
storage tank located at the above mentioned property and found that the determination made by Lt.
Peter Raiskio to abandon the tank in place to be reasonable based on the fact that removal ofthe tank
could jeopardize the structural integrity ofthe building.
According to Lt. Peter Raiskio the determination and prodcedue conducted to abandon the tank in
place was in conformance with 527 CMR 9.00.
Please keep in mind that ifyou decide to remove the tank at a later date, the tank removal may need
to be addressed by the Fire Department. Ifyou encounter contaminated soil during the removal of
the underground tank, you mus report your findings immediately to the Yarmouth Fire Department
and the Yarmouth Health Department.

On December 19, 1996, Paul Bates of The Cape CodFive Cents Savings Bank approved the actions taken on the abovepermit unaware of the stipulated contractual agreement pending.His decision rested on the premise that proper certification wasforthcoming from the appl i cant /mechani c Advanced EnviromentalServices that NO CONTAI4INATION existed at the permit site. To date, no Letter of Cert i f ication /Closure has been received byAttorney Richard Curley or MyseLf.
Therefore, as I am purchaser of contract for thisproperty, and with fulI knowl,edge as to the possible ramificationsdue to contamination, I am reguesting that a letter from AdvancedEnviromental Services certifying me absolutely NO contaminationexits at that sited area, or that a laboratory anaJ.ysis be startedimmediateJ.y (before 1/19/97 1 to certify said site. Suchdocumentation should include the site sample#; the 1ab testing thissample; the name of the technician testing the samplei and a copyof the test result.

Listing broker for this property, perk Beaudry, informedmyself and another broker that the soil sample did not have to betested because fourteen (14) days had passed. f was Iead to believethat the window for this was thirty days (30), and that when theChief returned from his time off, a letter with the test resuftsof this soil from a lab would be forthcoming. That Ietter was to besitting on his desk during the holidays, and you did not have accessto it.

Dear Mr. Grier;
On December 19,1997,I met with Advanced Environmental at the above mentioned property
concerning the structural integrity ofthe house ifthe oil tank was removed. It was determined by
all parties at the location that the front portion ofthe house would be in jeprody ofcollapse if the
tank was removed. The permit number for this property is 96-042.
I ordered Advanced Environmental to abandon the tank in place by cleaning all product from
the tank, remove the end ofthe tank with non sparking tools, then cutting the bottom center of
the tank so that a soil sample could be taken about I foot below the bottom ofthe tank, and
finally filling the tank with clean washed sand..
A (PID) detector was used in sampling the soil and no reading above 0.lppm was found, also
no smell or visual signs ofproduct was noticed. According the guidelines of527 CMR 9:00, and
EPA regulations this site was clean and the tank ceased to be a tank any longer.

On December 19, 1996 Advanced Environmental Services, Inc. (Advanced) conducted
the closure of a 500 gallon capacity steel, underground heating oil storage tank (UST) at
the above referenced property in West Yarmouth, Massachusetts (hereinafter the "Site").
The UST was located inside ofa concrete block bunker beneath the stairway and entrance
to the site building. Please see the attached Yarmouth Fire Department permit.
Upon arrival to the site, Advanced noted that the concrete block bunker acted as a
tbundation to a concrete and brick slab. This slab formed the entrance landing. Further
inspection ofthe bunker found significant cracks. In the opinion olAdvanced, if the LIS'l
was removed from the bunker the slab lying above it would have no support and would
collapse. It is also possible that the bunker walls would undergo further structural
damage.
In the opinion of Advanced based on our observations, abandonment ofthe UST in-place
was the safest course ofaction. This opinion was shared by Lieutenant Raiskio ofthe
Yarmouth Fire Department.
Advanced removed a?ortion ofa bunker wall after pumping the remaining oil from the
UST. Remaining sludge was removed from the UST and the interior was cleaned. The
interior of the UST was observed to be free of pitting and/or holes. The bottom ofthe
UST was cut open and a composite soil sample was collected from approximately one
foot below its bottom. The collected soil sample was field screened with a
photoionization detector (PID) using a headspace method, for the presence ofvolatile
organic compounds (VOCs). No VOCs were found above the PIDs minimum detection
limit of0.l part per million. No visual or olfactory evidence ofa release to the soil below
the UST was observed.

The UST was then backfilled with clean sand fill after approval was granted by
Lieutenant Raiskio. In the opinion ofAdvanced no further work is necessary at the site.
