The automatic sprinkler system is a required life safety system, and its impaired condition constitutes an unsafe condition under MGL c. 148 $ 34A, presenting a risk to occupants and property. Violation Failure to maintain the automatic sprinkler system in proper working order as required Code Authority and References . 527 CMR 1.00 S 13.3.3 - Required fire protection systems shall be maintained in accordance with their applicable NFPA standards.. 527 CMR 1 .00 S 13.3.3.1 - The building owner is responsible for the inspection, testing, and maintenance of fire protection systems. . NFPA 25 - Standard for the lnspection, Testing, and Maintenance of Water-Based Fire Protection Systems, which establishes required inspection, testing, maintenance, and corrective actions. This notice is issued pursuant to 527 CMR 1.00, the Massachusetts Comprehensive Fire Safety Code, and MGL c. 148 $ 34A, as adopted by the Commonwealth of Massachusetts, which authorizes the Fire Department to require correction of unsafe conditions in assembly occupancies and to ensure the proper maintenance of required life safety systems. . 527 CMR 1.00 S 1.7.2 - Authorizes the Authority Having Jurisdiction to issue orders necessary to correct violations and ensure compliance.. MGL c. 148 $ 34A - Authorizes the Fire Department to order the correction of unsafe conditions and to restrict or prohibit occupancy or use of assembly occupancies when such conditions exist. Order and Required Action You are hereby ordered to Correct the unsafe condition by restoring the automatic sprinkler system to full operable condition in accordance with NFPA 25, including all required inspection, testing, maintenance, and repairs. Submit a Sprinkler System Deficiency Correction Plan, prepared by a licensed fire protection contractor, detailing identified deficiencies, corrective actions, and an estimated completion date. Maintain the sprinkler system in service and protected from impairment until compliance is achieved, unless otherwise directed in writing by the Fire Department. Respectfully, Lt. Michael Oliva Yarmouth Fire Prevention Pursuant to MGL c. 148 $ 34A and 527 CMR 1.00, the Fire Department hereby determines that the failure to maintain the automatic sprinkler system constitutes an unsafe condition in an assembly occupancy. Failure to comply with this order by January 14,2026, may result in enforcement action, including orders restricting or prohibiting occupancy or use of the assembly space pursuant to MGL c. 148 $ 34A, as well as enforcement actions, penalties, or legal proceedings authorized under 527 CMR 1 .00 S 1 .7.13 and other applicable Massachusetts law. lf you have any questions or believe this notice has been issued in error, contact the Fire Prevention Bureau immediately.
