HomeMy WebLinkAbout2371L ANR Planner Report 011526 with Attach T O W N O F Y A R M O U T H 1146 ROUTE 28, SOUTH YARMOUTH, MASSACHUSETTS 02664-4492 Telephone (508) 398-2231, Ext. 1276, Fax (508) 398-2365 MEMORANDUM To: Planning Board From: Kathy Williams, Town Planner Date: January 15, 2026 Subject: Planner Report for ANR Plan #2371L Kings Way off Nottingham Drive (north side) Assessor Map 142, Parcel 17 Please find attached Application Form A and ANR Plan #2371L submitted by the Trustees of the Kings Way Condominium Trust for a portion of their property located off Nottingham Drive, Yarmouth Port, MA, Assessor Map 142.17. The ANR Plan creates a non-buildable lot for conveyance purposes. The portion of the Kings Way property north of Nottingham Drive, currently a wooded undeveloped area, is being carved off as a 3.14-acre unbuildable lot to be sold to the Town of Yarmouth for conservation purposes. This parcel abuts Taylor-Bray Farm and other conservation land. Funding authorization was received at the November 17, 2025 Special Town Meeting and the Zoning Board of Appeals has authorized the removal of the Open Space restriction on the proposed lot via Decision 5205. At the time of the ANR submission, the Decision had yet to be recorded, but a space has been provided on the plan to denote the Book and Page number. The submission was complete and included the required fee, Form A, ANR Plan, and the appropriate number of copies. The ANR Plan is entitled, “Plan of Land Off Nottingham Drive Assessor’s Map 142 Lot 17 Yarmouth, Massachusetts”. The Plan was prepared by Bradley K. Lemont PLS, Merrill Engineers and Land Surveyors, and is dated January 8, 2026 and stamped January 13, 2026. This application was received on January 14, 2026, and a decision is required by February 3, 2026 to remain within the 21-day statutory requirements. This project has been placed on the Planning Board Meeting Agenda for January 21, 2026. Planner Suggestion: Recommend the Planning Board make a motion to endorse ANR Plan #2371L prepared by Merrill Engineers and Land Surveyors and dated January 8, 2026 and stamped January 13, 2026, as amended to include the Book and Page number for the recorded Zoning Board of Appeals Decision 5205.
