Dear Property Owners,
Our records indicate that the Yarmouth Conservation Commission issued the following Order of Conditions for
the above-referenced property:
File#SE83-97 Issued 7/20/1977 Expired 7/20/1980 For repair and modification of an existing pier
system.
Although the Order has expired, whether the permit was issued to you or you purchased a property that had an
open permit, as the current owner of record, you are responsible for properly closing out this Order. Since the
Order was most likely recorded in your chain of title at the Barnstable County Registry of Deeds, it creates an
encumbrance on your title until it is properly closed out.
Please follow the Administrative Checklist and fill out Form 8A Request for Certificate of Compliance ("COC").
The forms and fee schedule can be found at www.yarmouth.ma.us/696/Filing-Forms. If the project has been
completed in accordance with plans stamped by a registered professional engineer, architect, landscape
architect or land surveyor, a written statement by such a professional certifying substantial compliance with the
plans approved in the Order (and/or describing deviations, if any exist, from the plans) must accompany the
Request. Down Cape Engineering submitted a request for a COC for this project in 2021, but it was
withdrawn to permit a new pier configuration. They may be able to assist with closing this permit.
Please submit the Administrative Checklist, completed Request for COC, certified professional
statement, and the filing fee to the Conservation Office. An electronic copy of the entire application
must also be submitted by emailing jjerolimo(a.varmouth.ma.us and bdirienzoAvarmouth.ma.us.
The Commission will then review and vote on the request at a scheduled meeting. If the request is approved, a
Certificate of Compliance will be issued to you, which will need to be recorded at the Barnstable County Registry
of Deeds to officially close out the permit. Your property's Conservation records can be found online at
