PETITION #5005: 1044 Route 28, Yarmouth
At its March 16th and April 6th, 2023, hearings, the Conservation Commission heard a
Notice of Intent for the proposed construction of a telecommunications facility within land
subject to coastal storm flowage. The Commission issued the Order of Conditions for
SE83-2382 on April 13th, 2023. The approved plans titled Blue Sky Towers III, LLC Plan
Set Sheets T 1, C 1, A 1-6, SE 1, D 1, CA 1-4, EC 1 was last revised on December 28th,
2022 and Drainage Report was last revised on December 29th 2022.
Special Condition 5 of the OOC states “Any change in the approved plan(s) shall require
the Applicant to file, in writing, a notice of project change with this Commission.” The
Conservation Commission has not yet received or reviewed such notice.
