Cape Cod Farms, 252 Route 28, West Yarmouth – Flavored Tobacco Violation Second Offense
Board of Health Hearing – September 15, 2025, at 5:00 p.m.
Dear Mr. Patel,
On August 19, 2025, a Barnstable County Inspector conducted a Retail Tobacco Check of your retail store. They found 5
cartons and 5 packs of Newport Menthol Cigarettes available for purchase.
You are in violation of the Board of Health Tobacco Control Regulation Section H that prohibits the sale of flavored tobacco.
You are hereby ordered to pay a fine of $2,000 (Second Offense Fine), and the Tobacco Sales permit shall be
suspended for seven (7) consecutive days as required by the Board of Health Tobacco Control Regulation, Section S. The
dates of the suspension will be sent by the Board of Health at the Hearing. First violation occurred on November 15, 2024.
You or a representative must appear at the Board of Health hearing scheduled for Monday, September 15, 2025, at
5:00 p.m. at Yarmouth Town Hall Hearing Room, 1146 Route 28. South Yarmouth, MA 02664. At the hearing you must
explain to the Board the steps you are taking to prevent the sale of flavored tobacco products in the future.
