Box 999 West Yarmouth, MA 02673-4698 Gentlemen: We have confirmed that it was not possible for you to remove the amount of material - 2500 gallons - that is noted on your invoice to us (No. 11143, dated 6/13/94) , see attached. Since you did not accept our previous thoughts on this matter, we obtained further inputs substantiating our position. Since our last discusion, we had the septic tank pumped and the leach field replaced. Fifteen hundred gallons were removed from the tank, its full capacity. About 600 gallons were removed from the area of the entire leach field, i . e. no significant fluid remained. From the design and installation information on the system in their files, the Yarmouth Health Department informed us that the maximum capacity_ of the leach field was 592gallons_ This corresponds to the amount removed when the field was replaced. When your employee began to pump out the leach field, after pumping the tank, he almost immediately said he could take out no more since his truck was full . To determine if much had been removed from the flowdiffusors and field, I asked him to place his shovel in the hole. He did and there was at least ten (10) inches of fluid covering the blade. Clearly, little material had been removed from the field. When I spoke with Ernie the next day about the apparent discrepency, he said he thought he had sent your employee to another Job first and would let me know. He never did confirm that. The design data on the system, the material remaining in the field at the time, and Ernie' s initial, quick response about an earlier Job all demonstrate that 2500 gallons were not removed by you_f rom_our_system. Lastly, we also understand that the normal fee for such pumping services on the Cape is ten (10) cents per gallon. Your charges are thirteen (13) cents - thirty (30) % higher. We are uncertain what the exact charges were when you disposed of the material in Warren RI . But, out of state delivery only makes sense if the costs are significantly lower than on the Cape. It is our conviction that no more than 300 gallons (one-half the capacity of the leach field) , if that much, was removed by your employee. Also, we do not believe it is appropriate to be charged more than the usual fee per gallon. In light of the above, enclosed is a check for two hundred thirty dollars ($230. 00) : one hundred eighty dollars ($180. 00) for pumping and disposal plus fifty dollars ($50. 00) for digging. As we discussed with you, this is the second time in two years that we have been billed erroneously for material. Last year you billed us for an amount of anti freeze for our heating system that was greater than the system' s capacity. You did correct the billing for that Job after we brought it to your attention. We will no longer plan to call on your services, which is indeed unfortunate after having done so for many years.
