Pursuant to the authority granted to the Head of the Fire Department as the Authority Having
Jurisdiction (AHJ) under 527 CMR 1.07( I ), and in accordance with 527 CMR I .07(6) relative to orders
addressing conditions of imminent hazard, this correspondence shall serve as a formal Order to
Immediately Vacate and Cease Occupancy or maintain constant fire watch of the premises known as
Aiden by Best Westem Cape Cod , located at 476 Route 28, West Yarmouth, Massachusetts.
On 0212612026, at approximately l8:50, members of the Yarmouth Fire Department conducted an
inspection of the above-referenced property. It was determined that the required fire alarm systan
serving this lodging occupancy is nonfunctional and incapable of providing required fire detection,
occupant notification, and transmission to the supervising station.
Observed deficiencies include, but are not limited to
. Fire alarm control panel in trouble/failure condition.
. Loss ofrequired supervising station monitoring.
. System incapable of providing occupant notification throughout the building.
Hotels and lodging houses are regulated occupancies under 527 CMR I .00 and are required to be
protected by an approved and properly maintained fire alarm system in accordance with 527 CMR L00,
Chapter 10, including 527 CMR 10.03 and applicable referenced standards (NFPA 72).
The failure of this life safety system constitutes an IMMINENT HAZARD as defined by 527 CMR
1.07(6), in that occupants would not receive timely waming in the event offire, thereby placing guests,
staff, and emergency responders at substantial risk ofserious injury or death.
Accordingly. you are hereby ORDERED to:
I . Maintain a municipal fire watch
Or
l. Immediately cease occupancy of the building.
2. Immediately evacuate all guests and non-essential personnel.
3. Discontinue all lodging operations until the fire alarm system is restored to full operational status

The premises shall remain closed to occupancy or under municipal fire watch until the following
conditions are met:
. The hre alarm system has been repaired by a properly licensed fire alarm contractor.
. The system has been fully tested in the presence of the Yarmouth Fire Department.
. Documentation verifuing compliance with 527 CMR 1.00 and NFPA 72 has been submitted.
. Written authorization to re-occupy has been issued by the Yarmouth Fire Department.
Failure to comply with this order may result in enforcement action pursu art to 527 CMR I .07, including
non-criminal disposition, criminal complaint, and any additional rernedies available under
Massachusetts General Laws.
This order is effective immediately upon service.
