MAR V 26 AR10:50 TOWN OF YARMOUTH BOARD OF APPEALS MEMORANDUM TO FILE SPECIAL PERMIT #4977 March 17, 2026 MEMBERS SITTING (March 12, 2026 hearing): Chairman Sean Igoe, Dick Martin, John Mantoni, Dick Neitz, and Rich Chwastiak. SPECIAL PERMIT 4977: Kings Way Trust, 64 Kings Circuit, Yarmouth Port, MA. Map & Lot #: 142.13-17. Zoning District: R-40. Third -year review per condition #2 of Special Permit No. 4977, dated November 4, 2022, allowing unlimited public play on the Kings Way Golf Course. On November 4, 2022, the Board granted Special Permit #4977 which modified the existing Special Permit #4282 and allowed unlimited public play on the Kings Way Golf Course. Special Permit #4977 included the following conditions: 1) The petitioner shall notify the Board when it enters into an operating contract for the golf course (it being anticipated that such a contract will provide for a three-year operating agreement); and 2) The Board will conduct a review of the golf operations annually, at the end of each of the three years following the commencement of the said operating agreement, in order to review the effects of the operation on the site and neighborhood. Subsequently, the petitioner provided a copy of the operating contract to the Board, and appeared before the Board for annual reviews on March 14, 2024; March 13, 2025; and March 12, 2026. At the March 12, 2026 hearing, Attorney David Reid represented the petitioner. There were no public comments. The Board was satisfied that the conditions had been met and no further review was required for Special Permit #4977. A motion was made by Mr. Martin and seconded by Mr. Neitz that the Board finds the petitioner is in compliance with the conditions of Special Permit #4977. The members voted as follows: Mr. Martin: AYE; Mr. Mantoni: AYE; Mr. Neitz: AYE; Mr. Chwastiak: AYE; Chairman Igoe: AYE. The motion was voted 5-0 in favor. Sean Igoe, Chairman
