On behalf of my client David McCarthy, please accept this request for a Certificate of Compliance for the
above referenced project. The order was recorded on 3/26/2018 under L.C. Certificate #194801. A site
inspection was performed by Shorefront Consulting on March 20, 2026 with field measurements taken for the
bulkhead and patio. Pictures of the mitigation plantings taken on March 20, 2026 are included with this
request, along with photos supplied by the owner for the mitigation plantings during the summer months. All
of the plantings appear to be robust and healthy. The patio and additional required mitigation was addressed
with an enforcement order issued in 2022. Additional mitigation was required to resolve the violation.
The proposed bulkhead reconstruction work is complete, and the patio work with additional mitigation
plantings is complete as well. An as-built plan is not required as part of the order. Field measurements and
previous photos confirm that the position, components, and elevation of the bulkhead comply with the permit
plan entitled “Sketch Plan Showing Proposed Bulkhead Reconstruction” by Shorefront Consulting, dated
12/14/17. The project was monitored and inspected by Shorefront Consulting during the 2021-2022
construction process. The bulkhead was re-constructed according to the permit, with no modifications or
deviations noted. There are no deviations from the plan observed during the time of inspection.
Therefore, the project has been completed in accordance with the Order of Conditions, and all Special Conditions
contained in SE-83-2150 issued on 3/26/18. Attached please find Yarmouth form WPA-8A Request for
Certificate of Compliance, photos of the completed project, and a check for $75 made payable to the Town of
Yarmouth.
Please include this request in your next public hearing. The original Certificate of Compliance should be mailed
to Shorefront Consulting for recording. If there are any questions or concerns regarding this request, please

subject of an Adjudicatory Hearing Final Decision, submit this request to the appropriate DEP Regional
