Garulay, RLA The applicant respectfully submits this request for a Certificate of Compliance in connection with the above-referenced Order ofConditions. In June 1992, the Commission issued an Order of Conditions authorizing the construction of a single-family dwelling on a previously vacant lot at 61 Pheasant Cove Circle. The Order of Conditions was recorded at the Barnstable Registry of Deeds in Deed Book 8097, Page 136. The reference plan is the approved Site Plan prepared by Down Cape Engineering, Inc., dated May 5, 1992. A site visit was made in October 2025 to assess the current conditions of the property relative to the requirements of the Order of Conditions and the approved Site Plan. The site visit confirmed that all permitted work has been completed. The property was found to be in substantial compliance with the approved Site Plan, only minor deviations from the permitted plans were observed, as described below. A small walkway was constructed connecting the gravel driveway to the front entry steps. At the time of construction, the walkway was located outside of the 100-foot buffer to the wetland. Although no deck is depicted on the approved Site Plan, a deck is shown on the Revised Septic System Certified Plot Plan dated July 26, 1996, and is referenced in Special Condition 24 of the Order of Conditions. Special Condition 24 states that the deck shall not be enclosed without a subsequent Conservation Commission filing. The deck is existing and has never been enclosed, accordingly, Special Condition 24 has been satisfied. An existing boardwalk extending approximately 43 .5 feet into the wetland was installed without prior Conservation Commission approval. Authorization for the existing boardwalk is being sought through a separate Notice of Intent filing submitted to the Commission on March 5, 2026 (SE 083-2525). Additionally, a 120-square-foot addition was constructed off the rear of the existing garage. This work received Conservation Commission approval at a hearing in October 2025. Site photos documenting current conditions are enclosed for review. This is to certify, to the best of my knowledge and belief, that the work was performed in substantial compliance with the approved plan and Order of Conditions.
