Yarmouth Assessor Map 32.120 - Village Centers Overlay District (VCOD) VC1 A. General Description: The currently developed 0.81-acre property along the Parkers River contains a commercial building with on-site septic, overhead utilities, paved parking and two curb cuts off Route 28. The site is located in a FEMA floodplain (Base Flood Elevations of 11 & 12) along with wetland resources and their buffers. The property also includes a 20’ wide pedestrian easement and 15’ wide vehicle easement for the purpose of public access to the Parkers River. The Applicant is proposing to redevelop the site utilizing Zoning Bylaw Section 414 - Village Centers Overlay District (VCOD) VC1. The project includes three (3) duplexes for a total of six (6) 4- bedroom residential units with parking below the units and accessed off a reduced single curb cut off Route 28. Landscaping has been provided with street trees and enhanced plantings in the wetland buffer areas. The units will be serviced with Town water and sewer, buried electric/communication utilities, gas, and drainage consisting of water quality catch basins/underground infiltration with a reduction in impervious area. B. Process-VCOD Site Plan Review: VCOD Design Standards per Section 414.8 and the Architectural & Site Design Standards are mandatory for VCOD projects, or relief is needed. The Planning Board reviews the project for compliance with these standards, however the VCOD SPR is not a Special Permit Decision and does not grant any zoning relief or make any zoning determinations. Applicants have the right to appeal the decision of the Planning Board to the Zoning Board of Appeals. Any zoning relief required would be done through the Zoning Board of Appeals (ZBA), as determined by the Building Commissioner. Final action by the Planning Board on VCOD applications needs to occur within 50 calendar days of the application submission. The application was received on December 23, 2025, along with a 30-calendar day extension followed by a 45-calendar day extension to allow time for the applicant to make revisions to the plans based on comments from the Design Review Committee and the Site Plan Review Team. The Planning Board has until April 26th to make a decision unless another extension is executed. This item is on the April 1st Planning Board Agenda. C. Comments from Other Committees: 1. Design Review Committee Comments: The applicant met with the Design Review Committee (DRC) on January 13, 2026 (see attached Design Review Comment Sheet). The DRC reviews VCOD projects for mandatory compliance as it relates to the Architectural and Site Design Standards and is advisory to the Planning Board. To address some DRC comments, the applicant Planning Division Planning Board 703 Route 28 March 26, 2026 Page 2 of 3 provided renderings showing the building colors and additional elevations for all sides of the three buildings; moved the street trees and transformer back from Route 28 to accommodate future takings for MassDOT Corridor Improvement projects; relocated the transformer to east of the entrance; and changed the type of fencing along the eastern property line to wood. The Building Commissioner has determined that side/rear buffer trees are not required except when VCOD projects abut residential properties (which this property does not), with buffers needing to only be vegetated. Please note that the building dimensions are 50’ or less so the comment regarding the 5’ modulation required is not appliable. An outstanding item from the DRC is in regard to the center building not having variations in the wall height. Special Permit relief would appear needed from the Architectural and Site Design Standards, Building Strategies Section 4 - Vary Wall Heights. It may make sense to seek relief for the center building height since little of it will be visible as it is well hidden by the adjacent buildings. The Planning Board may wish to document support for this relief. The DRC provided supplementary comments on the two parking spaces per unit shown and more may be needed for 4-bedroom units. As this is structured parking under the building, more than 2 spaces/unit are allowed by-right per Section 414.7.7. There is no room for parking anywhere else on the site without impacting emergency access. There may also be some difficulties with deliveries and moving vans, but the site is limited in size and want to maximize buffers to resource areas. The proximity of the fencing to the driveway may make it more difficult for vehicles to turn around and could be moved further away from the driveway or may not be necessary at this time with the dense arborvitae hedge, although it appears mostly located on the adjacent property. 2. Site Plan Review Team Comments: The applicant met with the Site Plan Review Team on January 20, 2026 (see attached SPR Comment Sheet) with plans modified from the DRC meeting. Please note that many comments from the SPR involve other regulations or permits that the Applicant must adhere to or obtain and are not under the purview of the VCOD SPR. The following summarizes Town Staff input along with updated information: a. Building: Due to the proximity of the site to Parkers River, the project qualifies for a minimum 30’ front yard setback so as not to impact the view of the river from Route 28; and buffer plantings appear to be acceptable. Zoning Board of Appeals (ZBA) Special Permit relief is needed for the Duplexes. The Planning Board may wish to document support for this relief. b. Planning & Community Development: One Affordable unit is required, and the applicant has indicated an interest in the option for payment in lieu of providing the unit. See DRC comments above on the building dimensions, wall height, landscaping, and accommodations made for future MassDOT projects and sidewalk. c. Conservation/Engineering: A Notice of Intent filing is required with the stormwater system meeting the MA Stormwater Standards and Riverfront Act. The Engineering Department will also need to sign off on their approval as part of the building permit process. The applicant submitted a detailed Stormwater Report including drainage calculations, erosion and sediment control during construction, and long-term operation & maintenance plan. Due to its size, and that stormwater is under the purview of others, the report has not been included with the attached application materials. d. Fire: Coordinated with the Fire Department on the current design confirming no sprinkler system or additional fire hydrant is needed. e. Health/Water/Wastewater: The applicant plans to wait to connect directly to the municipal wastewater system once it is operational. Planning Board 703 Route 28 March 26, 2026 Page 3 of 3 D. Planner Comments: The following is suggested language for consideration by the Planning Board. Motion to approve VCOD SPR #2025-2 for The Residences at Parkers River for a three duplex (6- unit) housing development at 703 Route 28 as presented at the Planning Board meeting of April 1, 2026 and in accordance with the plans and materials submitted, subject to the following conditions: 1. All parking to be located beneath the building with no parking allowed along the access road to ensure emergency access. 2. Provide one (1) affordable unit in compliance with Zoning Bylaw Section 412. 3. Any relief required shall be sought through the Zoning Board of Appeals. (BSC) is pleased to present the following application package for a multi-family residential development at 703 Route 28, on behalf of the Applicant, Steven M. Katz. This application is submitted pursuant to Section 414 of the Town of Yarmouth Zoning Bylaws, for VCOD development. The following summary has been prepared to assist the Town in its review of the proposed development, as outlined in the Operational Regulations of the Yarmouth Planning Board. Existing Site The site was previously developed as a commercial property and contains an existing one-story building, which was last operated as a furniture store and repair shop. The parcel is 35,248± square feet and is located in the B2 Zoning District and the VC1, ROAD, and GIZ Overlay Districts. The site has two (2) existing curb cuts along Route 28 and a paved parking lot. The site is located in a FEMA Zone AE but the existing building does not comply with FEMA regulations. The existing building, parking lot and the on-site sewage disposal system, all encroach on the buffer zones associated with the wetland resource areas that are associated with Parkers River. The building is currently served by an on-site sewage disposal system with a design flow of 1,800 gallons per day. The leaching facility associated with this system does not comply with Title 5, primarily because of its location, which is about 35 feet away from a wetland resource area. The existing building is served by overhead electric and telecommunications services, natural gas, and domestic water. Proposed Development The Applicant is proposing to redevelop this property by replacing the existing commercial building with three (3) duplexes, providing a total of six (6) residential units. Prior to construction of any new facilities, erosion and sedimentation controls will be established and the existing commercial building and shed will be demolished. The proposed redevelopment of the site will result in a decrease in impervious area of approximately 7,645 square feet. Site Access The site is located on Route 28, which is a State Highway. Therefore, an Access Permit is required by MassDOT prior to construction. The westerly curb cut will be closed permanently, and the easterly curb cut will be reconfigured to comply with both MassDOT and local requirements. Each unit will have its own garage, which has sufficient area for two (2) parking spaces without stacking. 349 Main Street, Route 28, Unit D / West Yarmouth, MA 02673 / 508-778-8919 Stormwater Management Stormwater management facilities have been designed in accordance with the Massachusetts Stormwater Handbook and the Town of Yarmouth Stormwater Management Regulations. Water quality catch basin units located on the eastern side of the driveway will collect stormwater runoff from the drive and surrounding areas and pre-treat stormwater prior to conveyance for recharge to the groundwater. A large subsurface infiltration system will be constructed beneath the driveway. The system is comprised of 91-Cultec C-100HD leaching chambers in a bed of crushed stone and has been designed to manage stormwater from design storms up to and including the 100-year storm. Each of the three (3) water quality catch basin units on-site will discharge pre-treated stormwater to this system. Utility Services The other utility services required to support this project include domestic water, electric, telecommunications and natural gas. The existing water service will need to be upgraded to a 2-inch pipe and reconfigured to serve the new buildings with each unit having a 1-inch service. The new buildings will also have natural gas, electric and telecommunications services. Wastewater Management As noted above, the site was previously served by an on-site sewage disposal system. This system will be abandoned-in-place and a 6-inch connection to the new municipal sewer system will be established prior to occupancy. Other Required Permits In addition to VCOD Site Plan Review approval, the proposed development also requires an Order of Conditions from the Yarmouth Conservation Commission and a variance from the Zoning Board of Appeals (Section 202.5) to allow construction of two-family dwellings in the VC1 Zoning District. At this time, BSC anticipates filing with the Conservation Commission to be heard at the April 16, 2026 public hearing. We will not file with the Zoning Board until such time that all other local permits are in hand. Finally, an Access Permit is required from Massachusetts Department of Transportation (MassDOT). BSC will apply for an Access Permit once all of the local permits are in hand, as required by MassDOT. We look forward to presenting this project to you at public hearing on April 1st. The Applicant is proposing the redevelopment of an existing commercial property in accordance with the provisions of the Village Center Overlay District (VC1), as multi-family housing with a total of six (6) units, which will be located within three duplex housing units. Access to the property is from Route 28. The existing curb cut will be reconfigured and realigned. The proposed buildings will be constructed on pilings and raised above the Flood Zone, in accordance with FEMA regulations. Each unit will have one (1) parking space located under the building. A paved connection to Mermaid Lane at the southern end of the site will be provided for emergency use only and controlled by a locked gate with Knox Box. The project will also require new utility services (including connection to the municipal sewer), stormwater management and landscaping.
