HomeMy WebLinkAbout0 - Variance Cover Letter www.BohlerEngineering.com 50 Washington Street, Suite 2000 Westborough, MA 01581 508.480.9900 March 30, 2026 Town of Yarmouth Board of Health 1146 Route 28 South Yarmouth, MA 02664 Attn: Hillard Boskey, MD., Board of Health Chair Re: 474 & 484 Station Avenue – Variance Application Station Avenue, South Yarmouth, MA Dr. Boskey, On behalf of the Applicant, Town Fair Tire, Bohler is pleased to provide submission materials to support a Septic Variance Application in support of a proposed retail storefront at 474 and 484 Station Avenue, South Yarmouth, MA; these lot(s) can otherwise be identified by the Town of Yarmouth Assessing Department as Map 97, Lot(s) 22 and 23-C1. Specifically, the applicant is requesting a variance from 310CMR 15.203(6) for use of design flows using actual meter readings of established flow from existing Town Fair Tires. As coordinated with your office, the following materials have been provided to the Town: • One (1) copy of the Cover Letter & Narrative; • One (1) copy of the completed Request for Variance Application; • One (1) copy of the completed Variance or Request Checklist; • One (1) copy of the full size (24x36) Site Development Plan, dated February 25, 2026; • One (1) copy of the half size (11x17) Site Development Plan, dated February 25, 2026; • One (1) copy of the half size (11x17) Boundary, Topographic & Utility Survey, prepared by Control Point Associates, and dated February 6, 2026 • One (1) copy of the half size (11x17) Sewage Disposal System Upgrade Plan to Replace System Serving Units “C-H”, prepared by Coastal Engineering Company, Inc., dated August 19, 2011, and revised through May 6, 2014. • One (1) copy of the half size (11x17) “Floor Plan & Elevations”, dated January 22, 2026, and revised through January 29, 2026. • One (1) copy of the Historical Town Fair Tire & Adjacent Unit Water Usage Summary • One (1) copy of the Certified Abutters Lists from the Town of Yarmouth • One (1) copy of the Abutter Notification Slips • One (1) copy of the Locus Map • One (1) check to the Town of Yarmouth in the amount of $55.00 The site is an existing shopping plaza containing seven (7) different operational retail store fronts. The parcel contains approximately 9.57± acres and is bound by existing commercial uses to the north, the Cape Cod Rail Trail to the south, a wooded area to the east, and Station Avenue to the west. The proposed development includes the construction of a new ±6,576 square foot Town Fair Tire retail storefront along with associated site-related improvements to support its customer base in the region. As such, the project proponent is seeking approval from the Town to connect to the existing on- site sanitary system to attenuate the anticipated flows from the proposed Town Fair Tire addition to the development. Per the record plans entitled “Sewage Disposal System Upgrade Plan to Replace System Serving Units “C-H”, dated August 19, 2011, and revised through May 6, 2014, the existing on-site septic system was designed and constructed to adequately accommodate the additional flows from the proposed Town Fair Tire. Per 310 CMR 15.203 (3) a proposed “Service Station [no gas]” would be the closest commercial use and would require 150 gallons per day (GPD) per bay. From the applicant’s experience, this proposed flow is significantly higher than actual water usage. As a reference for these calculations, a typical Town Fair Tire averages around 76 GPD, with a max documented usage of 115 GPD. However, in alignment with Title V, we've used the highest observed usage (115 GPD) multiplied by 200%, resulting in 230 GPD for these calculations. Additionally, the applicant reviewed historical water usage for each unit in the existing shopping center and generally found it to be consistent with the proposed calculations previously approved. A summary and copy said water bills have been included with this application for reference. With that, the total calculated anticipated flows to the existing septic system would be 1,606 GPD. This figure includes the existing uses within the shopping center going to this system, as well as the new Town Fair Tire. The proposed total flow remains under the permitted flow1,692.4 GPD. As a result, it is our belief that the existing on-site septic system is able to accommodate the proposed flows and function as intended in the original design and in accordance with Title V regulations.
