Re: Defective filing of Petition to Appeal seeking reversal of the Yarmouth Town
Committee's, disapproval of Yarmouth Application 421-A111 requesting a Certificate of
Appropriateness for the installation of a rooftop solar panel array on a roof located at 23
Willow Street, Yarmouth Port, Massachusetts. Said property is shown on Town Map 112
as Lot 46.
Dear Ann & John Hill,
Your Appeal Petition submitted without filing of a copy (Notice) with the Yarmouth
Town Clerk and Town Committee is rejected due to your failure to follow 972 CMR
Rules and Regulations Section 1.03, Clause d (e.) which states as follows:
4. (e.) Prior to the expiration of time ivithin which an appeal may be submitted, the
Appellant shall also mail or deliver a copy of the appeal to.- 1_ Town Clerk, 2. Town Committee,
and 3. Applicant (if different frown appellant}.
Failure to comply with the above public notice requirement is considered a jurisdictional
defect and prevents the Regional Commission from hearing your appeal.
