Dear Mr. Wood:
Be advised that a public hearing will be held by the Yarmouth Board of Health on
Monday, October 7 at 7|3O p.m. in the Yarmouth Town Hall, lower meeting room, to
discuss the above subject. Your presence is required at the above hearing, along with
a representative from the company's management to explain the company's response
to the spill. The Board of Health and other town departments are distressed that the
company did not notify any town agency within two hours of detection of a spill, as
requlred by Town of Yarmouth by-law, Chapter 90. Such failure to rePort a spill is
punishable by a fine of up to $200 per day.
In addition to the above notice of hearing, I am still awaiting your report of actions
taken by your company in response to the above-mentioned oil spill, dating from the
time the leakage was first detected. Please address the following items in your report:
Why was the Town of Yarmouth not notified until 48 hours after leakage was
first detected ?
2. What is the status of repairs to the pump chamber of the septic system in
order to render the leaching field operable?
3. Why did the unused fuel oil tank remain underground for approximately four
years in violation of Massachusetts State Fire Prevention Regulations?
4. What is the status of monitoring wells to be installed both in the immediate
area of the problem tanh and, as previously discussed with the company,
toward the northeast corner of the property?
You are hereby required to respond in writing to this department within 48 hours of
receipt of this notice with your report of the incident, If you cannot do so, please
inform the Health Department in writing of the reasons why this is not possible.

Board of Health hearing regarding-Com monwealth Electric incident
September 20, 1985
On September 18, you received a copy of a notice sent to Commonwealth Electric
informing them that the Board of Health will conduct a hearing regarding the above on
October 7. The purpose of the hearing is twofold: first, to discuss the oil leakage of
August 26 in general, and secondly, to discuss the company's violation of both Chapter
90 of the Town of Yarmouth by-law and the Board of Health regulations on underground
storage tanks, by failure to report the leakage to town authorities. I am soliciting your
written comments to be presented to the Board of Health at the hearing; you are also
invited to appear personally at the hearing with your comments on the case. Please
let me know in advance if you wish to speak at the hearing.
