(BSC) is filing this Request for a Certificate of Compliance (RCOC) on behalf of Steven Katz (the applicant) for a project that was completed at 703 Route 28, South Yarmouth, Massachusetts (the Site). The Order of Conditions (OOC SE83-075) was issued on March 15th, 1979, and referenced a plan titled “Plan to Accompany Petition of Gordon Gardiner et ux To Place and Maintain Rip Rap and Fill in Parkers River – Revised November 1978.” The approved project was to construct a rip rap seawall along the perimeter of the property along Parker’s River. Neither BSC, nor the current owner and applicant were involved with the permitting or construction done for the approved project. However, the approved project does appear to have been completed in compliance with the approved plans and OOC. During BSC’s existing conditions survey, BSC surveyed the location of the seawall. Based on BSC’s survey and the approved plans, the seawall appears to be constructed in the correct location. As such, we are requesting that a certificate of compliance be issued to close out the OOC. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. Refer to Meeting Schedule. • Failure to follow the Administrative Checklist shall result in an Administrative Incomplete Application and will not be scheduled for a Public Hearing. • Contact the Conservation Office if you need assistance. Signed statement from an Engineer or similar professional who prepared the approved plan stating the date of a recent site inspection and certifying compliance with the permit and outlining departures from the approved plan, if any exist. If mitigation planting was required, include planting date and confirm the required time has elapsed*.
