Thanks so much for forwarding the link.
property owner familiar with Jeff Chizmas, I have a significant concerns.
While Mr. Chizmas does have mobility concerns, he also has a history of pushing limits, suing
or threatening to sue neighbors, and not fully abiding by Conservation Commission directives.
I can't argue against a longer dock for his current boat as such may facilitate docking in the
setting of his mentioned mobility issues.
I am concerned however that this is a subtle first step to obtaining a larger boat, a wish Jeff has
shared with others over time.
Therefore, on the occasion of the forthcoming Conservation Committee meeting, I would hope
that the attached meeting minutes are recalled and enforced.
If approval for the dock reconfiguration is approved, It should be recalled that a boat longer than 24
feet is not allowed on the dock.
Please acknowledge the receipt of this email and let me know if my concerns can be related
anonymously. I am hesitant to stand up publicly given past threats of legal action whenever
one challenges Mr Chizmas.

MINUTES REGULAR MEETING
December 14, 2011

Meeting called to order at 7:00 p.m.
Minutes of 9/14/11 and 11/2/11 were approved as written, motioned by Al Keller and
seconded by Bob
Churchill.
Robert Perry of Cape Cod Engineering presented a Notice of Intent and associated revised
plan, on
behalf of Jeffrey Chizmas, 66A River Street, South Yarmouth, for the construction of a pile
supported
pier, ramp, float and dredging. Bob also stated that he has spoken with Terry Clen, Dennis
Harbormaster, and has a letter stating the moorings in the channel will be relocated.
Ellie Lawrence was concerned with the location stating it’s a very tight area and sail boats use
that area
to maneuver its tack.
Bob Churchill stated his concern of the location as sailboats need that deep water section to
tack and
navigate. He continued to state there are 3 factors which need to be considered:
1. Shoaling area – frequent or infrequent?
2. The committee has no jurisdiction on the size of the vessel permitted to be on the dock
3. Traffic increase on Bass River over the past few years
Karl stated he did receive the letter from Terry Clen about the mooring relocation however he
can’t
guarantee that they will be relocated come next season. He also voiced his concerns as to the
congestion of the area; current velocity, wind, tide, boat congestion, swimmers, moored boats
(etc..) in
this portion of the river poses some unique navigational challenges to the power and sail
boaters. In
addition the dock structure and associated boat will present a visually perceived obstruction
within this
congested area that will present an additional factor even though it will not extend a great
distance out
into the waterway. If this structure is expanded in the future it will present a physical obstacle
to boats
navigating in this portion of the river. Karl also stated as proposed the dredged area will silt in
and not
benefit the shellfish habitat. He requested that the dredge cut be more gradual to allow for the
fine
sediments to pass along the cut and get stuck in the dredges area.
Capt. Bob Levange stated he has sailed and captained many boats thru the river, as well as
taught
numerous students how to sail in the river and quoted Ordinance 9. He also stated his expertise
is in
hazards to navigation and did not feel the dock would be any hazard.Jeffrey Chizmas stated
they have met all the setbacks required by ConCom and the committee, it would
be a safer area for swimmers, there would be plenty of water and area for sail boats to
maneuver and
that his dock request should be approved.
After lengthy discussion Al Keller made a motion to approve the dredging and reduce the structure to
1- 8’ x 24’ float, a restriction be placed in the Order of Conditions to be recorded on the deed that it
be
permitted for a 24’ vessel only with no future expansion. Upon receipt and review of the above
recommendations and revisions to the realigned dredge area submitted to Karl and was
seconded by
George Lucier, unanimously voted to support the project by all members. Mr. Chizmas did
state his
intentions was to only place a boat under 24 feet on the dock and had no future desire to
expand.
Al Keller addressed Karl and the committee on several items:
Bulletin Board at Packet Landing – Who has the key and how do they go about posting
brochures?
Also, need a divider as brochures are smaller than pockets. Karl replied all postings and
brochures
need to go thru him at the office and he will have one of his staff look into dividers.
Water Pressure at Packet Landing - The end slips have very little pressure. Karl stated all the
lines
were tested and it was recommended a bigger trunk line be installed. However this will likely
not
improve the pressure to a noticeable level.
Transient slip rentals – Why were we not allowed to rent a slip to the F/V Triton and others
yet we
allowed the F/V Old Dog conch boat? Karl stated he had concerns as to possible damage
caused by
Tropical Storm Irene that the docks needed to be inspected prior to any additional boat of
substantial size >35’ where dock at the facility adding additional stress to the structure.
Rates at Packet Landing – Are they going up per the 3 year schedule? It was discussed by all
members to ask the Board of Selectmen keep the rates the same for next season due to the
economy. Ellie motioned to approve and Bob seconded. Unanimous by all members.
