Replenishment
To the Conservation Commission,
I have been asked to provide information concerning the sediment donation made at the
referenced site during April 2025 in connection with an Order of Conditions for DEP File
No. SE83-2437.
Two sieve test reports are attached as are photographs of the activity during the work
effort and a sand lading slip record.
From what I have determined, from looking back at my records, sand was discussed
between me and the applicant in the fall of 2024 but no action was taken to hire anyone
or begin that process. Next, an email was sent to me last April 2025 by Ms. Awad about
cleaning up the several pieces of visible coir roll debris and fabric remnants and a
comment was made about adding sand. The mention of adding sand did not register as I
was likely busy and neglected to remind her of the time of year restriction. Typically, if
there would be any sand placement action we would assist to coordinate and I would be
contacted by the sand delivery contractor. Your office would also be contacted and we
would nix the process due to our routine understanding of the time of year restriction.
My records indicate I was not contacted by the contractor. Apparently on April 22, 2025
sand delivery began, ending on April 25. The sand slip indicates it was sold to “RB
Coastal Services LLC” of Sandwich. In my experience, companies providing “coastal
services" would be familiar with Orders of Conditions and / or the common practice of
acquiring any specification for doing the work that might be part of an Order or Cert. of
Compliance.
I recognize that I had an opportunity when the email arrived to more carefully consider
the contents of the email and I believe it came in on the phone, off hours and I missed the
opportunity to remind the applicant of the permit time of year limitations. I am unaware
of any contact that was made by the sand delivery contractor to me or the Yarmouth
Conservation Commission in advance of the activity. The owner is disappointed the
system of communication broke down and has indicated to me that she, as the self-

assigned property manager for her home, needs to revisit this with the sand contractor
and be more critically careful going forward.

We are requested to outline circumstances that may be inconsistent with the Order of
Conditions.
Special Conditions are on page 7A:
Special Condition No. 4. – Pre-construction contact and meeting is required with the
Conservation staff. I have no information that such contact of meeting took place. There
may be phone records but I am unaware of any.
Special Condition No. 12 – Requires sand fill grain size analysis. I recently took a
sample from each end of the fill zone and have attached the two sieve reports. Typically,
the upland source sediment supplier would provide sieve reports for sand fill being sold
for beach fill and I have no information about the existence of such records. Our samples
were taken from deep into the in-place deposit and would be an accurate record of the
overall soil texture the day of delivery. Clean, medium-grained sand. Lading slip for the
material is attached.
