The proposed work is within Buffer Zones to Coastal Bank(310 CMR 10.30),Salt Marsh (310 CMR 10.32),and Bordering Vegetated Wetlands(310 CMR 10.55),as defined in the Wetlands Protection Act Regulations,but will not alter an Area Subject to Protection under the Act.Therefore,said work does not require the filing of a Notice of Intent when it is conducted in such a manner as to prevent erosion and siltation of adjacent wetlands,and when it is conducted in accordance with all other applicable federal,state,or local statutes,ordinances,bylaws,or regulations. The Yarmouth Conservation Commission issued an Order of Conditions on September 23,2025,citing Chapter 143 of the Yarmouth Wetland Bylaw—designating the activity described in the Request as an activity that is subject to review under the municipal bylaw,via the filing of a Notice of Intent. In accordance with MassDEP Wetlands Program Policy 91-1:Plan Changes- Administrative Appeals Policy for the Review of Project Plan Changes,March 1,1995,the Department reviewed a revised plan dated January 5,2026 as referenced in the enclosed SDOA.The revised plan relocates all of the proposed work outside any area subject to This information is available in alternate format Please contact MassDEP at 617-292-5500. The Policy states; "The primary purpose of this policy is to promote the intent of the Wetlands Protection Act, M.G.L. c. 131 s.40, to ensure thorough local review of work proposed in or near wetland resource areas by identifying those circumstances in which the Department will consider changes to plans filed under Notices of Intent(NOI)which are before the Department under appeal fora Superseding Order of Conditions (SOC)" and; "The Department may consider plans which contain insubstantial changes from the plans acted upon by the Conservation Commission and referenced in the Order of Conditions. Insubstantial plan changes are limited to those changes which involve unchanged or decreased impacts but which do not constitute significant changes from the project configuration acted upon by the Conservation Commission" The applicant has demonstrated to the satisfaction of the Department that revisions to the project wilt result in decreased impacts to wetland resource areas compared to the plan referenced in the Town of Yarmouth Order of Conditions that is the subject of this appeal. In the Department's opinion, sufficient information has been submitted to identify the proposed work adequately and to determine the regulatory applicability of the Massachusetts Wetlands Protection Act. Please be advised that the Department reserves the right, should there be further proceedings in the matter to raise additional issues and present further evidence as may be appropriate. Please also be advised that the Department does not have the authority to regulate or enforce local by-laws or Conservation Commission policies.
