I just discussed the situation with Brittany, and she suggested you could
attempt to permit the patio with a Request for Determination of
Applicability (RDA). You would still need to have the wetland delineated,
but you would not need a surveyed site plan. I can also apply the fee you
already submitted for the administrative review toward the RDA fee. There
is no guarantee that the Commission will approve the RDA, and in that
case, you would be back to either removal or submitting an NOI.

Thank you for coming to the office today to talk about the
unpermitted patio at 689 Willow Street. As we discussed, the
two most likely ways to bring your property into compliance
would be to either have the patio removed or to apply to have it
permitted after-the-fact. Since it appears to be more than 50
feet from the wetland, and is greater than 300 square feet,
permitting would most likely require you to file a Notice of
Intent (NOI). I have attached a list of consultants who can help
with the permitting process as well as the approved plant list
we discussed so you can have an idea of what would be
involved.
I will be in touch next week once I’ve had a chance to discuss
the situation with Brittany, the Conservation Administrator. Let

looks like the round patio to the right of
the driveway never received approval
through Conservation. Looks like it was
built around 2021.
Please let me know if you have any
record of approval. Unfortunately, I
won’t be able to approve the fence until
we resolve the patio issue.
