Hi Brittany & Joe,
Attached here are the revised NOI packet and plan set for 703 Route 28 in
Yarmouth. I am printing stuff out now and will be coming by your office to drop off
hard copies. Your original comments are copied and pasted below with answers.
General
Variance needed from 50' no build buffer zone Included variance request.
structures should be no closer than existing (66.3' existing, 46.2' proposed) from
coastal bank- there appears to be space for the houses to remain outside 50',
can you please submit an alternatives analysis exploring this and why it isn’t
possible? Existing building is 36.2” from coastal bank, proposed is 46.2’ from
coastal bank; 10’ further than existing. Can’t move buildings further from River
because of driveway and stormwater infiltration system which is as far from
resource areas as possible, and buildings are as close to driveway/infiltration
system as possible. I added text about this to the Alternative Analysis section.
What is the proposed surface for the 5’ pedestrian pathway? Why is this
needed/can it be minimized? Mulch pathway proposed. Requested variance.
Would be amendable to shell path or another alternative. There is a pedestrian
easement along Parker’s River, so we need to provide access.
Work Limit Line: I will recommend tightening it to just past existing edge of
pavement to protect any existing buffer within the no disturb 35’ buffer zone No
work inside 35’ buffer except for plantings along parkers river.
Plants
A vegetated buffer exists on the west and south sides- what are its
components? If native plants are present, they must remain and be protected
during the work. I recommend assessment of the components of the existing
plants and keep/protect all native species, flush cut any if they are damaged,
removing any invasive species, and supplementing where needed with
additional plantings
species, DBH, and location of any trees to be removed must be shown on the
demo plan. We are proposed to keep native trees over 4” DBH. Most of the
larger trees are autumn olive.
Plant spacing must be shown on landscape plan. Table now includes spacing
for each plant.
Include the seed components of 'erosion control seed mix' and where it will be
applied on landscape plan. Inlcuded.
What is proposed in the area between structures and planted buffer? If
lawn/grass, detail the seed/species proposed and maintenance needs. Seed
mix included.

Show square footage of proposed planted buffer vs existing vegetated buffer
Included in narrative. Existing buffer is 2,469 sf and Proposed buffer is 3,386sf.
Larger shrubs with varying heights preferred. Included some red cedar, red
maple, and bayberry.

Hello,
BSC would like to request to continue the NOI and RCOC for 703 Route 28 until the
June 4th Yarmouth Conservation Commission hearing. We will have all of your
edits/comments addressed to you before a week before the hearing date.
I will try to get a status of the cleanup on Site, but the proposed project itself is
redevelopment of previously degraded RFA. So, if/when the project gets approved
then the entire Site will be cleaned up and redeveloped and all potential hazards on
Site would be removed.

Would you like to continue the COC request as well? The Commission may want to
discuss the site conditions. When we did the site visit yesterday they were pretty
concerned about the trash, car batteries and antifreeze that were all being stored out
in the open so close to the river.

Hi Joe,
Attached here is the updated certified abutters list. Ownership of the abutting
properties has not changed. Also attached are the green certified mail receipts from
the abutter notifications. Also attached is the updated NOI packet with the Alternative
Analysis updated with square footages.
Our engineer is updating the project plans with the 35’, 50’ and 100’ buffer to coastal
bank lines as well as updating the impact table to display those impacts. I will email
you a PDF of those once i have the updated plans.
We will have the hard copies of the updated plan and NOI packet to you tomorrow
before noon. For the hard copies, do you want multiple copies of the revised plan
and NOI? Maybe just multiple copies of the updated project narrative and the plan
sheet C-2.0? Let me know, thank you!

I have reviewed your NOI and it is currently administratively incomplete. In order to be
scheduled on the 5/7/2026 agenda we will need the following by noon on 4/23/2026.
A current (<30 days old) abutters list.
Certified Mail Receipts (PS Form 3800) for all abutters matching the revised list.
The alternatives analysis should be revised to include the actual area values
rather than “XX”.
The resource area impact table on sheet C-2.0 should be revised according to
our plan requirements by including the 0-35’, 35-50’ and 50-100’ buffers.
The signature page does not include a date for the applicant’s signature.

Attached here is a notice of intent application that is being submitted with the
Yarmouth Conservation Department for proposed work at 703 Route 28 in South
Yarmouth. There are two attachments here. I will send a separate email with a pdf of
the stormwater report as I cannot fit all three attachments in this email.

Hardcopies of the application, project plans, and town checks will be dropped off in
Yarmouth.
The DEP share of the WPA fee will be certified mailed to the DEP lockbox in Boston.
