Subject: Request for Compliance of Noise Ordinance-Early Morning Waste Collection Noise
Regularly Impacting Residential Community
Dear General Managers,
On behalf of the Gateway Isles Homeowners Association and its residents,we are writing to
bring to your direct attention ongoing noise disturbances associated with early morning
waste collection activities in key commercial areas of Yarmouth.
Gateway Isles is a residential neighborhood located near several hotels,motels,restaurants,
and cottage-style lodging properties serviced by regional waste haulers.While we recognize
the essential role your companies play in supporting these businesses,current collection
practices are resulting in repeated and significant disruptions during designated quiet
hours of 11pm to 7am as outlined in the Town of Yarmouth Noise Ordinance.
Observed Activity
• Backup alarms operating for extended periods
• Repetitive dumpster handling and compaction noise
• Engine idling and maneuvering in close proximity to residential areas
These activities are not isolated incidents but occur with regular frequency.
Geographic Impact
Due to the nature of the equipment and tile surrounding environment,noise originating
from multiple nearby commercial zones—including South Shore Drive hotels,as well as
motel and cottage properties along Sea View Avenue and Neptune Lane—regularly carries
into the Gateway Isles neighborhood.Depending on conditions,these disturbances are
audible across a broad area and affect a substantial number of homes.
Prior Outreach
Residents and members of our association have previously raised these concerns with
individual businesses and with local authorities.While some progress has been made in
isolated cases,the underlying issue persists and appears to be driven largely by early-
morning service schedules and operating practices.
Expectation of Compliance of the Noise Ordinance
•Avoidance of waste collection activities prior to 7:00 AM,including review and adjustment
of route schedule to align with local ordinance
• Reinforcement of compliance expectations with drivers and subcontractors
Requested Operational Considerations in Good Faith Effort
• Minimizing duration of backup alarm use where safe and appropriate
• Utilizing newer,lower-noise alarm technologies where available
• Reducing unnecessary idling and staging time near residential zones
Path Forward
This letter is intended to bring visibility to the issue and prompt corrective action at the
operational level. Relevant Town officials are copied to ensure alignment and awareness.
We are hopeful that,with appropriate attention and coordination,these disturbances can be
significantly reduced without disruption to your core operations.Again, we are only
asking that your operations comply with both local and state ordinances which govern
quiet hours of between 11pm and 7am.
We would welcome the opportunity to discuss this matter further to ensure smooth
operations of your business while at the same time respecting the quality of life of nearby
residents.
