Hi Brittany;
My responses in red below. I use Autocad and the bank profile to figure volume per
linear foot and then into cubic yards. It's an estimate, and likely is more because
where the section line is taken where the stairs are, and the distance from the wall to
the bank is a little greater as you move south away from the dock. It's all just an
estimate; heck one big storm and it changes the whole thing, so it's just an estimate
based on the 2026 "snapshot" of the survey.
and another draft revision for you.

Hi,
Thanks for the draft. My comments below:
Refer to the planting plan wherever you mention plants so Lynne can design that-
in 3 of the 5 detail sections, note 6, etc I added "refer to planting plan" innote 6, section A-A elevation, Bulkhead sheeting detail, and the fiber rolldetail. Note 6 added the approximate fill volume of 5 yds (also onelevation A-A- detail), and noted to maintain sand cover fiber rolls, andplantings.

Please provide on narrative or plan:
What is the volume of sediment proposed to nourish the fiber rolls initially and
ongoing? This should be based somewhat on the local erosion rate, which should
also be provided. A sieve analysis is needed for existing sediment as part of the
application to inform the type of new sediment to use as nourishment. Fillvolume is about 5 yards behind the wall (depends on how close we canput it to the bottom of the bank slope); autocad tells me 3 yds. I'm goingwith 5 just in case.
Erosion rate; good question. There's no data for that here. I looked atthe bottom of bank lines from 2013 and 2026, and the bottom of bankactually moved seaward about 0.2 of a foot; presumably from erosion ofthe bank over 13 years. So if I calculate the length 88'+/-, times theeroded height of 4.7', times 0.2' of width, I get 83 cubic feet, or about 3yards. Divide that by 13 years and you get about .23 yards per year for13 years. And .02 feet erosion for 13 years is about .015 feet per year. Pretty small.
What is the volume and composition of sediment for behind the bulkhead? Thefill for the fiber rolls is also estimated to be 5 cubic yards. Any sedimentused for fill or cover should match the bank material. I added note 17 torequire a seive analysis of the bank and the fill, and that they shouldclosely match, and that the agent has to approve the sieve prior to anyplacement. This is what Kelly did in the past. I can get a sieve now, but Idon't know how long that will take; the goal is to make sure we get bothand that they match "close enough", so that's how I worded note 17.That can also be a special condition.

Hi there;
Attached is a draft revised plan, revised narrative, and revised NOI sheet
for the LSCSF resource area.
Personally, I still think there's only coastal beach and coastal bank on
this property; I've never delineated LSCSF on this type of topography.
Having said that, the resource area table on the original plan stated
LSCSF, and unfortunately that was left in from another project.
I put it all in the plan, narrative, resource area table, and the NOI form
anyway, because for me it just doesn't make that much difference, and
I'd rather do what you want than argue about it.
Please take a look at the plan; I put in all the comments from Joe and
Brittany, and it should be good.
I am also sending it to Lynne for the plantings.
I won't be able to get the plan for the planting plan done before the 11th,
unless Lynne can work a miracle or the surveyor happens to be on the
cape, so plan on putting this on the July 2 agenda.
Please let me know the plan revision is okay, and I'll send it to the
surveyor for stamping right away.
Thanks very much for taking a look at it.

The flood zone is up to el 9, top of coastal bank is higher, so the work
takes place in both. You already have it on the plan, just need to add
it to the NOI for impact area and narrative for perf. Standards.
Only buffer zones relevant to the work should be shown, so it is fine
but remove the 35 riverfront.
Planting plan is required due to square feet.
The plan requirements aren’t met, so you can provide the revised
stamped plan, noi supplement, and planting plans by June 11th at
noon; or we can place this on the July 2 agenda while those are
generated.

Thanks Brittany;
I understand fully where you are coming from and I respect
that.
At this point, we can inform the commission that there are
some additional items that you want included in a formal plan
revision; no worries. I can gather anything else they need
tomorrow night and continue the hearing and provide what
they want in a formal revision.
Not arguing; trying to understand where LSCSF is; the way I
saw it, the coastal bank comes right down to the coastal
beach, so I didn't think there's LSCSF. I can certainly provide
that on the plan; it would be a duplicate of resource areas
between the bottom of the bank up to the flood elevation,
right? I was considering it fill on a coastal bank; not LSCSF.
You're correct about the 35' Riverfront Area offset. I see in
the new plan instructions about the resource area offsets. I
can add the 35, 50 and 100-foot lines for the saltmarsh, and
coastal beach, but that's a lot of lines!
I just took the landward most resource area (TOB) and offset
35, 50 and 100 from that. Are you sure you want 9 different
lines for those 3 resource areas?
You're right about the fiber rolls; it's like 30 feet long and 6
feet wide, so about 180 square feet. Will I need Lynne again,
or can we just specify what we want down there, or eliminate
the woody shrubs and just use beach grass? That would
simplify things. Obviously continue the hearing until I can get
her involved again.
I guess for most of these tomorrow and on the 18th, I can
gather all the information that the commission wants,
continue the hearing, and provide it. Exactly what we did for
Chalifoux on 49 Neptune Lane. Two hearings and everything
went well. That would be my expectation. I gave the drafts
"in good faith" so you know I will provide that information.
We don't have to confuse the commission with those; we can
show the original stamped plan and they can know that
revisions are in process.
I like your idea about submitting a draft plan prior to filing;
thanks for that. Some towns won't do that without a formal
filing, so I appreciate the cooperation. The new plan rules
were a surprise for me, and complicated things a lot.
The filings I have before you are all I have for now in
Yarmouth. I have one other but I don't know when I'll have
the survey to start it. I will make sure that one goes more
smoothly than these.
See you tomorrow night.
Respectfully,
Mark Burgess

Hi Mark,
Fill is proposed in LSCSF between MHW and el 9 - that is
impact- so the full area covered by the fill should be
listed and included in the narrative. It can be a
supplemental page so not to edit the whole thing.
The riverfront area doesn’t have a 35’ buffer but salt
marsh does.
The beach grass behind the wall is only 180 SF but what
about the fiber roll plantings? This area will put the total
over the threshold requiring a planting plan since the
array is at least 40 feet long and at least 4/5 feet wide
and fully planted with unspecified shrubs and beach
grass
What is the volume of sediment proposed to nourish the
rolls? A sieve analysis will be needed for existing
sediment to compare to the new sediment.
The commission only reviews stamped plans. I wasn’t
aware we were reviewing drafts for other project- this
was not intentional and won’t be allowed in the future. I
suggest you thoroughly review the site plan
requirements and perhaps submit a draft to staff prior to
stamping and printing copies to avoid these ‘
completeness’ revisions before the meeting. The
commission can also decide not to review any testimony
on a project until they have a site plan which meets all
the requirements.

Hi Joe;
Thanks for your comments. They do provide a
clearer, more readable plan and I appreciate that. I
think you can see why originals are a problem; it's
void now and we haven't even gotten to the
hearing.
I revised the plan to label the wall more clearly,
added in the beach grass plantings (about 180
square feet so no worries there), and a dimension
for the wall movement. This is now a draft plan
like the other projects we're doing together.
For this site, I did not consider any of the area to
be within LSCSF; that's usually for areas that are
fairly flat, from the back of a bulkhead up to the
flood zone, with no coastal bank. Since there's a
bank here, I don't see where there is LSCSF. So I
haven't (for now) revised the NOI or the narrative.
Now, not trying to be argumentative, just
practical: My suggestion for plans, moving
forward, is that we do our best together to provide
a plan for the board like we've been doing. That
works well, and since I do my own drafting, I can
respond quickly. The first plan (of course) is
stamped; I have plenty of time to get that done for
a filing. This surveyor is out in Douglass, MA
(they moved from the cape), so it's difficult and
time consuming to get originals quickly. Any
revisions void the first plan, so I just don't think
it's a good use of time and money to get a stamp
for any revisions until the final plan is approved.
Like the others we have, my opinion is that we can
proceed with a draft revised plan, knowing that a
stamped plan was submitted for the filing, and
then require the original after any further revisions
and prior to the issuance of the order. The project
can be approved, but continued to the next hearing
for the board to approve the order, and if the
original isn't there by then, the project can be
continued again (for missing information) for the
stamped original and then the order can be issued
without starting the 21-day clock.
I understand why originals are required, (even
though the current state since COVID really
doesn't use them anymore) and getting a final
original (after the first stamped submittal)
accomplishes this goal without running around to
get an original every time a revision is made.
Does that make sense?
Please advise,
Respecfully,
Mark Burgess

Hi Joe;
Attached is a digital copy of the filing

This one is above MHW so it doesn't
have to go to DMF.
Let me know if you need anything else.
