VIOLATION NOTICE
RE: 354 Forest Rd - Camping and Recreational Equipment
Dear Alden Childs,
This letter constitutes a formal zoning enforcement order under MGL Ch 40A.
May 22, 2026
The Building Department has been in contact with you in letters dated 212/2024 and 9/27/24 regarding a boat
which is parked in front of the building on this property. The Town of Yarmouth has updated the Zoning Bylaw
allowing you to apply for a special permit to store a boat in front of the building. There is no record of any relief
for this property. This is a violation of the Town of Yarmouth Zoning Bylaws section 401.1.2.
401.1 Camping and Recreational Equipment.
401.1.2 If camping or recreational equipment is parked or stored outside of a garage, it shall be parked or stored
to the rear of the front of the building line of the lot, except for loading and unloading.
If a boat cannot be parked or stored to the rear of the front building line of the lot in a Residential Zoning District
due to a unique condition or features of the parcel, such as restricted or limited access to the side or rear of the
building, relief may be granted via a Special Permit from the Zoning Board of Appeals. In addition to other
applicable special permit requirements, the following conditions also apply:
s Limited to one (1) boat per parcel, lawfully registered to the owner or resident of the property
a Maximum length of 28' and located on a registered trailer
a Boat shall be parked in the driveway of a residential parcel without creating a traffic or fire safety issue, and
adequate remaining on -site parking for the property can be demonstrated.
a Special Permits shall expire upon transfer of the property.
Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed.
101.3 Penalties. Any person violating any of the provisions of this bylaw shall be fined not more than three
hundred dollars ($300) for each offense. Each day that such violation continues shall constitute a separate
offense.
You are hereby ordered to abate and or correct said violations or seek relief from the Zoning Board of Appeals
as allowed by MGL Ch 40a §7 & § 15. You also have the right to appeal this decision with the Zoning Board of
Appeals within 30 days of this letter.
You are required to respond within 7 days of this letter.
