Dear Property Owners,
As you are aware, your property is located in the scenic and historic Old King's Highway Regional Historic
District.
The Yarmouth Old King's Highway District office has received inquiries regarding the fence that was
recently installed on your property.
Please note that fences need approval from the OKH Committee prior to installation. As such, you are
hereby informed that you are currently in violation of the OKH Act for the following reason(s):
1. Installation of a fence without approval from Yarmouth Old King's Highway Committee
for appropriateness and setting.
To clear this violation, the Yarmouth OKH Committee requests that approval for the fence be obtained
within 30 days of receipt of this notice.
Enclosed are the OKH District fence requirements. To seek approval for a fence, please complete the
appropriate application and return it to the Yarmouth OKH office for review. Applications can be found on
the OKH Department page on the Town's website at: http:l/www.yannouth.ma.u&f375/Old-Kings-
Highway-Historic-District.
Please note that failure to comply with the OKH Regional Historic District Act is subject to fines and
penalties as allowed per Section 12 of the Act.
We appreciate the efforts you have put forth to beautify your home and property, and it is our sincere hope
that you understand our position and act swiftly to remedy the above -mentioned concern.
Any objection or inquiry in reference to this notice should be filed in writing and addressed to: Town of
Yarmouth/OKHC, 1146 Route 28, South Yarmouth, MA 02664 or okh yarmouth.ma.us.

FENCES
Criteria:
• All new or altered fences require approval regardless of height or material
• Vinyl fences, regardless of height, are prohibited in the OKH district
+ Wooden fences are preferred; chain link fences usually are not considered appropriate
+ In limited cases other materials have been approved (i.e., a metal pool fence well back on a secluded lot
where the fence could not be seen from a public way)
• If proposing a material other than wood, be prepared to explain why an alternative is necessary
• Height limit is 6 feet. Taller fences will be considered if topography of the lot makes them necessary
• Fencing over 4 feet high is prohibited forward of the front fascia of a building
Application Requirements:
1. The request qualifies for a Certificate of Exemption if the proposed fence is wooden and four feet or less in
height, is appropriate to the site and associated structure(s), and constructed in one of the following styles:
o Split, half -round, or round post and rail in natural (unpainted) finish
o Square rail in white or natural (unpainted) finish
o Vertical picket in white or natural (unpainted) finish
o Vertical flat board with cap rail 4.6 inches wide in white or natural (unpainted) finish
o Finished side of fence must face out from fenced -in area
Certificate of Exemption requirements:
o Certificate of Exemption application
o Site/plot plan showing running footage and location offence and gates in relation to other structures
on the property
o Drawing, brochure, or photos showing the style of proposed fence and gates
o Color photos of front of house and location of the proposed fence
o $20.00 application/filing fee
o Certificates of Exemption are reviewed by the Old King's Highway Committee Chair
2. The request requires a Certificate of Appropriateness for the following criteria:
o Wooden fences over 4 feet and up to 6 feet high
o Fences made of any material other than wood
o Finished side offence must face out from fenced -in area
Certificate of Appropriateness requirements:
o Certificate of Appropriateness application
* Four copies of the general specification sheet (listing the fence type, height, and materials)
o Four copies of the site/plot plan showing running footage and location of the fence and gates in
relation to other structures on the property
o Four copies of drawings, brochures, or photos showing the style of the proposed fence and gates
Four copies of color photos (front of house and location of proposed fence)
c $25.00 application/filing fee
o Certificates of Appropriateness are reviewed at an Old King's Highway Committee hearing
