arrangement made via telephone call on October 28, 2021 , with the Yarmouth Fire Department. The
phone conversation confirmed that the UPS facility located at 131 Ansell Hallet Road, West Yarmouth,
MA, is within the jurisdiction of the Yarmouth Fire Department. ln the event of an emergency, the
Yarmouth Fire Department will respond to said address with fire and ambulance services.
The facility's Hazardous Waste Contingency Plan is enclosed with this letter to help familiarize you with
the site.

Hazardous Waste Contingency Plan
(For use in states which have not adopted the Generator lmprovement Rule (GlR))
A. Purpose (262.341a1(41, 262.34(dll4l, 265.5'1, 265.52(a), 265.52(c), 265.53, 265.56)
The preparedness and prevention requirements of the Resource Conservation and Recovery Act
(RCRA) in 40 CFR 265 specify equipment, procedures, and emergency response arrangements
for all Small Quantity (SOG) (40 CFR 262.34(dX4)) and Large Quantity Generators (LOG) (40
CFR 262.34(a)(4)) of regulated hazardous wastes. ln addition,40 CFR 262.34(a)(4) requires that
LQG facilities have a written contingency plan that minimizes the hazards to human health and
the environment from unplanned releases of hazardous wastes, as well as establish the
procedures to be followed in the event of an emergency. Because the requirements in RCRA are
similar to those found in the Emergency Response Plan (ERP) required by OSHA in 29 CFR,
UPS has chosen to add Appendix XV to the ERPs of subject facilities with the RcRA-required
elements pertaining to hazardous waste.
This site-specific Hazardous Waste Contingency Plan is the facility's plan for dealing with
emergencies involving hazardous wastes and shall be implemented immediately whenever there
is a fire, explosion, or release of hazardous wastes which could threaten human health and/or the
environment. A copy will be kept onsite in the facility's ERP. Additional copies will be provided
to local emergency agencies as required by RCRA.

ln the event ofan emergency involving, or potentially involving, hazardous wastes, the Emergency
Coordinator shall have the overall responsibility for implementing the Contingency plan and the
applicable sections of the Emergency Response Plan. Emergency Coordinators are typically
Building and systems Engineering (BasE) management personnel if domiciled at the facility.
Otherwise, the highest ranking, onsite operations manager is the designated Emergency
Coordinator. Emergency Coordinators must be thoroughly familiar with this Contingency Plan, allfacility operations and activities, the types and characteristics of waste handled, the location ofpertinent records and the facility layout. The Emergency Coordinator is responsible for assessingpossible hazards to human health and the environment that may result during a release, fire or

explosion. The Emergency Coordinator is authorized to commit the resources necessary to
implement this Contingency Plan.
At ali times there must be at least one Emergency Coordinator on the premises or on call available
to respond to an emergency by reaching the facility within a short period of time. Emergency
Coordinators are required by RCRA to receive annual, documented training.
See Appendix A for Emergency Coordinator contact information.
D. Local Emergency Response Arrangements (265.37, 265.52(c), 265.53(b))
This section of the Contingency Plan supplements the Pre-Emergency Planning section of the
facility's Emergency Response Plan. Section I of the ERP provides a form and instruction for
facilities to prearrange emergency planning and coordination arrangements with the local
authorities. ln cases where no arrangements exist records shall confirm that aftempts to make such
arrangements were made. Contact sheets documenting arrangements with the various agencies
are attached to the Contingency Plan as Appendix A. The agencies listed in Appendix A are the
primary response units. lf other agencies may also respond, their contact sheets indicate that they
are secondary responders. A listing with emergency phone numbers is posted in the DM P/waste
processing area where most hazardous wasles are handled. A copy of the conlingency plan and
each subsequent revision or amendment to the contingency plan is submitted to the agencies listed
in Appendix A. Communication devices listed in Section H are available for this area as well as
the hazardous waste storage area.

E. Emergency Procedures, Evacuation and Equipment Shutdown (265.51, 2G5.52(a),
26s.52(f), 265.56)
The facility's Emergency Action Plan (ERP) includes the evacuation plans and procedures for
various types of emergencies. These procedures include the Emergency Coordinator
assessing the emergency conditions and hazards; notifying facility personnel and designated
state and local authorities; emergency measures to be taken; and actions to manage wastes
generated by the emergency.
The Emergency Coordinator or designee shall respond promptly and properly to any emergencies
that arise. The applicable responses shall be:
o ln the event of a fire, attempt to extinguish it using a fire extinguisher or other suitable fire
control equipment or call the fire department
. ln the event of a spill, contain the flow of spilled material to the extent possible, and as
soon as practicable, clean up the spilled material and contaminated materials.
\Menever there is an imminent or actual emergency situation, the Emergency Coordinator (or
designee) must immediately:
1 . Activate internal facility alarms or communication systems to notiry all facility personnel;
2. Notify the Massachusetts Bureau of Waste Prevention when there is an imminent or aclual
emergency which triggers the need to implement the contingency plan even if it does not result
in a reportable release (pursuant to 310 CMR 40.0000); and
3. Notify other appropriate State and local agencbs with designated response roles if their help
is needed.

The Emergency Coordinator must assess possible hazards to human health or the environment
that may result from the release, flre or explosion.
lf the Emergency Coordinator determines that the facility has had a release, fire or explosion
that could threaten human health or the environment outside of the facility, the Emergency
Coordinator must:
. lmmediately notify appropriate local authorities and be available to help appropriate
officials decide whether local areas should be evacuated;
Call the Bureau of Waste Site Clean-up at the Department's Regional Office serving the
location where the release or threat of release occurred when required by and within the
time frames established pursuant to 310 CMR 40.0311 through 40.0317. To report a
release after normal business hours, dial (617) 556-1133, (888) 304-1133 (or such other
telephone number as may be designated by the Department) or follow any instructions
provided on the answering message for the Regional Office; and
lmmediately notify either the government official designated as the on-scene coordinator
for the geographical area, or the National Response Center (800-424-8802) with the
following information:
o Emergency Coordinator name and telephone number,
o Name, address, and EPA ldentification Number of the facility,
o Time and type of incident (e.9., release, fire)
o Name and quantity of materials involved to the extent known,
o Extent of injuries, if any,
o Estimated quantity and disposition of recovered materials, if any; and
o Possible hazards to human health and the environment outside the facility.
During the emergency, the Emergency Coordinator must take all reasonable measures necessary to
ensure that fires, explosions, and releases do not occur, recur, or spread to other hazardous waste at
the facilny. Section lX of the ERP includes procedures for management personnel to shut down
equipment and operations throughout the facility. The facility's waste generating processes (i.e. spill
cleanup and fleet maintenance) do not involve any automated processes that require shut down. The
central accumulation for hazardous waste is stored in the facility's DMP and/or hazardous waste
storage area. The facility's ERP (Section ll) also includes a Leaking Package Response procedure,
which addresses the spills of products which become hazardous waste. Spills and leaks that occur in
the DMP/hazardous waste storage areas would cleaned up followlng the Leaking package Response
Procedure. The Site Diagram in Appendix B includes evacuation routes and alternate evacuation
routes for cases where primary routes could be blocked.
F. Description of Hazardous Waste Operations

Unless state regulations diciate otherwise, LQGS are facilities lhat generale more than 1,000 kg (2,200 lbs) of
hazardous waste or '1 kg (2.2 lbs) of acute hazardous waste in any one month. SOGS are facilities that generate
between 100 kg (220 lbs) and 1000 kg of hazardous waste in any one month.

x 1. Damaged Materials Program (DMP)
The DMP was created to ensure proper handling and disposal of regulated
materials originating from shipments that are damaged while in transit. Damaged
packages that are leaking are evaluated by trained Designated Responders.
These Designated Responders are generally UPS employees, but circumstances
may dictate that an outside response contractor be used. Designated Responders
clean up the spill residues, containerize the waste materials, and submit key
information to a third party hazardous waste vendor for a determination of the
materials' regulatory status. Waste codes most often include D001 (lgnitable) or
D002 (Corrosive) but vary widely due to the nature of customer shipments.
ln the typical UPS "small package" facility, individual packages containing regulated
materials generally contain a maximum of five gallons, which serves to minimize the
potential for a significant release to the environment. The damaged package contenls
and spill cleanup residues are individually container2ed and lab-packed into UN
approved drums. Some types of wastes, such as aerosol cans, broken fluorescent
lamps, and paint may be accumulated in bulk in drums rather than laFpacked.
ln other types of facilities, regulated materials can be packaged individually or
containerized. ln the event of a spill, the facility will contact an outside emergency
responder. Any damaged package contents and spill cleanup residues are
containerized by the responder for removal from the facility. Some types of facility
generaled wastes, such as aerosol cans, broken fluorescent lamps, and paint may
be accumulated in bulk in drums rather than lab-packed.
Facility-Generated Wastes
The mosl common source of regulated waste materials originating from onsite
operations is the Automotive Shop. Depending on state regulations and vendor
recycling processes, many wastestreams from the Automotive Shop are not
regulated as hazardous wastes. The following facility-generated wastestreams at
this facility are managed as hazardous wastes:

The table below indicates the emergency equipment present at this facility. Personal protective
equipment (PPE) and spill clean up materials are maintained primarily in the DMP processing
area. However, spill clean up materials are located on mobile carts that can be brought to any
spill location. UPS Designated Responders are trained in the use, capabilities, maintenance and
decontamination of PPE and spill clean up tools. The training also includes procedures for
notifying outside emergency response authorities, particularly when the size or nature of a release
is beyond the facility's capabilities.
ln facilities that do not have DMP, and therefore do not respond to spills, employees are trained
to report any spills or releases to management immediately. The Emergency Coordinator will
contact the outside emergency responder. The facility does not maintain any specialized
equipment other than basic PPE and materials to clean up minor spills of materials used at the
facility during rouline operation.
Some of the PPE and spill clean up equipment (e.9. stir sticks, pH tape, paper towels, etc.) are
disposable and will be included with the clean up residues for disposal. ln addition, Designated
Responders may also dispose of equipment that is easily replaceable (e.9. aprons, boots, gloves,
etc.) when it is excessively contaminated. Decontamination procedures are provided in the
Decontamination Checklist (Section Vl) of the Emergency Response Plan.

The ERP provides for the regular inventory and assessment of PPE and spill clean up tools used by
UPS Designated Responders (see section titled PPE and Response Supplies). These records are
generally kept in the DMP processing area or the spill €rt storage area. The Building and Systems
Engineering Department is responsible for the inspection, testing, and maintenance of the facility's
emergency equipment, including fire control systems (water pressure and volume), portable fire
extinguishers, eyewash/showers, two-way communication, evacuation alarms, etc. These records
are kept with the equipment or in the Building and Systems Engineering ofiice at this facility.
All UPS personnel are responsible for keeping evacuation routes clear. Aisle space in the
hazardous waste generation and storage areas is maintained by UPS responders to allow the
unobstructed access of emergency equipment and personnel in the event of an emergency.
Whenever hazardous waste is being handled, all employees involved in the operation must have
immediate access to an internal alarm or emergency communication device, either directly or
through visual or voice contact with another employee. lf only one employee is on the premises
while the facility is operating, the employee must have immediate access to a communication
device capable of reaching exernal emergency assistance.

l. Post-lncident Reporting and Follow Up (265.56)
lmmediately after the incident, the Emergency Coordinator will provide for the proper containment
and storage of any waste materials as a result of the emergency while offsite disposal is being
arranged. The Emergency Coordinator will ensure that no waste that may be incompatible with
the release material is managed in the affected area untilthe cleanup is complete. The Emergency
Coordinator will ensure that equipment used during the incident is cleaned or replaced before
hazardous waste operations may resume.
A UPS Oil/Hazardous Substance Spill lncident Report will be completed and maintained on file
for all external notifications triggered by implementing the Contingency Plan. This report must
note the time, date, and details of any incident that requires implementing the Contingency Plan.
This record shall be kept by the generator at a readily accessible on-site location at all times while
the generator is subject to 310 CMR 30.0000. The Emergency Coordinator will determine if a
written report is required to be submitted to local, state, orfederal authorities and, rf so, will ensure
its timely submittal.
lf the incident resulted in a release to the environment requiring notification pursuant to 310 CMR
40.0000, notification to the Bureau of Waste Site Clean-up shall constitute nolice to the
Department. lf the incident did not require notificalion pursuant to 3'10 CMR 40.0000, then the
generator shall provide a written report within seven days to the Bureau of Waste Prevention at
the Regional Office ofthe Department where the incident occurred which includes:
. Name, address, and telephone number ofthe generator;
. Date, time, and type of incident (e.9., fire, explosion);
. Name and quantity of material(s) involved;
. Extent of injuries, if any;
. Assessment of actual or potential hazards to public health, safety, wetfare, or the environment,
when this is applicable;
. Estimated quantity and the disposition of recovered material that resulted from the incident;
. All differences between the emergency response activities actually taken and those
prescribed in the contingency plan and the reasons for each such difference; and
. Proposed measures to prevent similar incidents in the fiJture.
J. Amendment of Contingency Plan (265.541
This plan must be reviewed, and immediately amended, if necessary, whenever:
1. Applicable regulations are revised;
2. The plan fails in an emergency;
3. The facility changes its design, construction, operation, maintenance, or other circumstances
in a way that materially increases the potential for fires, explosions, or releases of hazardous
waste or hazardous waste constituents, or changes the response necessary in an emergency;4. The list of emergency coordinators changes;
5. The list of emergency equipment changes;
6. There occurs any other circumstance which indicates the need for a change in thecontingency plan
The Building and systems Engineering Department is responsible for making any requiredchanges to the contingency Plan. Regardless of the extent of changes madetotie plin (even ifjust the contact tist is amended), BasE must submit the plan in its e;tirety to the agencie; listedin Appendix A.
