Comments IA uildinq: Table 202.5— L5 Other Auto Services use requires a SP in the B1 zoning district and a variance for this use in the APD. All lighting, signage etc. to comply with all relevant sections of the zoning bylaw. Previous decisions with the ZBA indicate that trees would be planted to comply with the in-lot tree requirements of the zoning bylaw. It appears that a significant number of the trees have been removed and should be replaced as part of this project or seek relief in the form of a variance from the ZBA to deviate from these requirements. It is assumed that adequate parking spaces are provided with the increased use. All construction to comply with 780 CMR and appendant codes. vivki)Planning: The applicant has done a nice job with the layout of the parking spaces with landscaped islands near the V. proposed building. However, some trees originally planted as part of the plaza have been removed over time and the property owners needs to replace them. Design Review: Refer to the attached May 19, 2026 Design Review Comment Sheet. Conservation: The proposed work is outside conservation jurisdiction. Enqineerinq: Clean out existing catch basins. If necessary, reach out to DPW Engineering for assistance with ddressing. 4 Fire: A PIV will be needed if no direct access to sprinkler room, fire dept. lock box for access to building, 527 CMR 1 is the fire code for retail tire storage. Request review of tree placement for YFD access. Health: BOH variance of April 6, 2026 granted for actual flow Health (Hazardous Materials): Storage of toxic or hazardous materials of more than ten gallons liquid measure or five pounds dry weight requires a Board of Health, Handling and Storage of Toxic or Hazardous Materials license. Please refer to the Town of Yarmouth, Board of Health Regulation, Handling and Storage of Toxic or Hazardous Materials. Please complete an Aquifer Protection Bylaw Application for Determination of Non-Applicability, and a Board of Health Hazardous Materials Registration Form. On the forms, please itemize the "household quantities" of toxic and hazardous materials listed on your Site Plan Review Application. If you store twenty gallons (quantities not greater than those commonly associated with normal household use) or more of toxic or hazardous materials, you will need to apply for zoning relief with the Zoning Board of Appeals (ZBA), and such relief is not guaranteed. (Yarmouth Zoning Bylaw 406.5.1.1) On Sheet C-501, is the component designated B-50 PROP TIGHT TANK, a holding tank that receives from service bay floor drains? Consult with the Town Plumbing and Gas Inspector on whether floor drains are required in the vehicle service bays. If floor drains are required, they must be connected to a holding tank designed in accordance with 314 CMR 18, Industrial Wastewater Holding Tank and Container Construction, Operation, and Record Keeping Requirements. On Sheet C-902, does the 1000-gallon septic tank represent the B-10 PROP PUMP CHAMBER shown, on Sheet 501? Water: Domestic water and Fire lines will require a Water Connection Permit and the associated backflow device will require a Cross Connection Design Data permit (also in OpenGov). Project Summary General Description:The Applicant seeks to construct a new 6,576+/-square foot Town Fair Tire retail store connected to the southern end of the existing building within the plaza,along with associated parking,landscaping, and utilities. Summary of Presentation: Matt Ashley gave an overview of the project including the approximately 6,600 square foot building for Town Fair Tire with retail in the front and 5 car loading bays in the back for tire installation/alignments.They are utilizing the existing grass area identified for future expansion.Will be replacing the parking in kind near the expansion with the inclusion of additional in-lot planting islands.Drainage will go into a recharge system in the rear.Already have water on site and will be tying in.The Board of Health has approved the additional flow into the existing septic system. Andrew Milliken outlined the architecture with the extension of the building following the same form with gable end. The side wall is shown dressed up with pilasters,additional windows in customer waiting area with the upper part of the wall shown being panelized.The materials are copying what is in place,extending the brick along the front facade.There already appears to be some EFIS material along the upper part of the facade with some texture. Working to mimic this so the expansion looks like part of the original building.The southeast elevation is currently painted concrete block,but they are proposing improvements to cap off the end of the plaza.Roofing shingles would match as close as possible. DRC Questions&Discussions: Peter Slovak had them clarify the landscaped islands to which the applicant reviewed L101—Landscape Plan.He further inquired about irrigation with the applicant indicating they would not be adding in irrigation but would keep the plants watered.Mr.Slovak asked if the Barnstable Town Fair Tire would remain open which it will.Mr.Slovak asked why they chose this site.They noted they preferred this site to the available Rite Aid property in Dennis.Mr. Slovak asked about the lost trees in the parking lot.Kathy Williams mentioned they would need to be replanted by the owner and it may be a ZBA condition of approval to replant the trees. Mr. Slovak asked about any Development of Regional Impact(DRI) implications. Kathy Williams noted that the plaza was developed in 1986 prior to the DRI process and this is a separate project of less than 10,000 sf. Discussed the traffic with the applicant noting a peak of about 7 vehicles based on ITE. The applicant noted most of their work is by appointment. Peter Malpass was delighted and thanked them from an economic standpoint and noted they did a thorough job on the application.
