Dear Property Owner,
Our records indicate that the Yarmouth Conservation Commission issued the following Order of
Conditions for the address referenced above:
SE83-1645 Construction of a single-family dwelling. Issued 9/23/2003 Expired 9/23/2006
SE83-1453 Construction of a single-family dwelling. Issued 10/8/1998 Expired 10/8/2001
SE83-1072 Use of fill. Issued 7/11/1990 Expired 7/11/1993
Although these Orders have expired, whether the permit was issued to you or you purchased a
property that had an open permit, as the current owner of record, you are responsible for properly
closing out this Order. Since the Orders were recorded in your chain of title at the Barnstable County
Registry of Deeds, it creates an encumbrance on your title until it is properly closed out. As part of
these orders, a request for a Certificate of Compliance is required to close out the application.
Please follow the Administrative Checklist and fill out Form 8A - Request for Certificate of
Compliance. The forms and fee schedule can be found at https://www.yarmouth.ma.us/696/Filing-
Forms-and-Information. If the project has been completed in accordance with plans stamped by a
registered professional engineer, architect, landscape architect or land surveyor, a written statement
by such a professional certifying substantial compliance with the plans approved in the Order (and/or
describing deviations, if any exist, from the plans) must accompany the Request. The representatives
for these orders included Down Cape Engineering and Hamlyn Consulting. Your property’s
Conservation records can be found online at https://lf.yarmouth.ma.us/WebLink.
Please submit the Administrative Checklist, completed Request for COC, certified professional
statement, stamped as-built plan and the filing fee to the Conservation Office. An electronic
copy of the entire application must also be submitted by emailing jjerolimo@yarmouth.ma.us
and bdirienzo@yarmouth.ma.us.
The Commission will review and vote on the request at a scheduled meeting. If the request is
approved, a Certificate of Compliance (COC) will be issued to you, which will need to be recorded at
the Barnstable County Registry of Deeds to officially close out the permit.
