Vegetation removed Date:Thursday, July 16, 2026 9:25:00 AM Hello again Chris and Erin, Just wanted to follow up to let you know the Conservation Administrator, Brittany, agreed that you don’t need to have a professionally prepared plan. If you need any help, you can also stop by the Conservation office at Town Hall or arrange a site visit with her. She has a background in botany so she can help make sure the plants you choose will survive well and look nice. Vegetation removed Hello Chris, Thank you for the phone call earlier to discuss replanting at 204 Setucket Rd. Please see the attached list of approved plants and where to source them. It is a long list, so here are some that we often recommend: Trees: northern red oak, black oak, scarlet oak, eastern red cedar Medium shrubs: viburnum, swamp azalea, sweet pepperbush, highbush blueberry, northern bayberry Low shrubs: sweet fern, bearberry As we discussed, the next steps will be for you to provide a planting plan for approval by Conservation. The plants should cover the area where vegetation was removed (roughly from the shed back) and should include a mix of at least three species and include trees and shrubs. With an area this size (around 3000sf) the Commission usually requires the plan be prepared by a landscape professional. However, since you’re cooperating willingly on an old violation, they may prefer you invest that money in plants rather than hiring someone to draw up a plan. I will check with them and get back to you as soon as I know. Let’s say 9/17/2026 as the deadline for the planting plan with the goal of planting in the Fall. Hi Joe, Thank you again for being helpful with the information provided, it would be great to have a call to go over the request and understand the process. Would you have time on Monday or Tuesday morning if I gave you a call? I would be available between 8-10am on Monday or 10am-12pm on Tuesday. If those times don't work for you I can be flexible if you propose timing. Have a great weekend, thank you. The patterned portion is the approximate area of a mapped wetland, specifically the type of wetland is labeled as “wooded swamp mixed trees”. This is only an estimated area, the actual boundary of the wetland would need to be marked in the field by a professional. Massmapper is a public tool if you have other questions, just keep in mind that the measurement tools and mapped wetlands are estimates. Aerial views - Both maps I sent have a scale in the bottom left corner, but again I would stress that the scale is approximate. Vegetation removed Hi Joe, Apologies for the delay, below are a few follow up questions: Massmapper - it's not clear from the key what the land behind the property line is designated as, can you please clarify this? Aerial views - these are excluding any sort of key to mark distance, can you please include this? Also adding my husband Chris here to track our conversation. Let us know, thank you! Vegetation removed Hello, Thank you again for taking my call earlier regarding your property located at 204 Setucket Rd. in Yarmouth. As we discussed, the Conservation Commission of Yarmouth has information that there may have been a violation of the Massachusetts Wetlands Protection Act, G.L. c.131 §40 and its regulations at 310 CMR 10.00 and/or the Town of Yarmouth Wetland By-law, Chapter 143 and its regulations. The activity which may have impacted the wetland resource areas is the removal of vegetation, including several trees. I have attached an aerial image showing the property from April 2023 compared to April 2026. I have also included an image from Massmapper which shows the estimated wetland boundary. In order to resolve this type of violation the Commission requires that the area be restored to its previous condition by replanting approved native plants. If it is determined that a violation did occur, failure to comply could result in further Enforcement action and potential fines. Once you have had a chance to review, or if you need more information, please contact myself or the Conservation Administrator (cc’d on this email) to discuss.
