The site includes 10 units which are being used as multi-family in violation of the Zoning Bylaw. The Condo Association has applied for a Special Permit with the ZBA using Bylaw Section 104.3.2(4) which allows for this conversion if certain criteria are met. At the 2014 ATM, we also included the requirement that the applicants go through DR and SPR and develop improvement plans to accommodate this new use (see attached). They are going back before the ZBA on May 7th. This has been a difficult site to improve due to the small size, desire for 20 parking spaces, limited funds available and the need to work with a Condominium Association. I have been working with the applicant’s representatives (Attorney Paul Tardif and Kieran Healy of BSC Group) to develop site improvements that reduce the large number of curb cuts and amount of impervious; improve safety by reducing the number of parking spaces that back into traffic and better defining the parking and on-site traffic pattern; and improve the buffer areas. I have the following comments on the latest site plan: 1. The eastern curb cut on Route 28 cannot be widened as shown. To get the fire engine around, it may impact parking space 3B. Although 20 spaces is ideal, it may not be feasible on this site. Only 15 spaces are required by the Bylaw. 2. More street trees are going to be required at the corner of Route 28 and Seaview Ave and along Seaview. There is a rather nice existing tree at the corner of Seaview and Howes that should remain and could be considered a street tree, which could eliminate one of the new trees in this area (to be used elsewhere). Existing trees to remain need to be identified so we know where the gaps are located. 3. Dumpster area needs some work. I would prefer to have it screened, located further away from the ROW and behind a buffer area. 4. Sidewalk needs to be extended at the western curb cut on Route 28. 5. Traffic should be limited to one-way along eastern access from south to north with No Parking signs attached to existing fence to retain a fire lane. 6. The existing Condo Rules & Regulations do not allow for the placement of furniture or any other articles in the common areas, so the hay bales, gnome and “stuff” in front of unit 3 and elsewhere on the property should be removed and noted on the plan.   We still need to deal with the buildings and general maintenance/clean-up items. This is being held up somewhat due to the Condominium Association documents that need to be amended to allow for communal work on the building facades. Attorney Tardif is working on this. I have asked them to bring photos of all the buildings facing any public way so we can get some input from the DRC on building improvements. The main issue with the buildings appears to be lack of maintenance and the need for general repairs and clean- up. Minor changes like paint colors along the Route 28 facades and more shutters, in addition to repairs, may result in low cost improvements. I don’t see any need to make changes to the roofline or building offsets. 2 Have a great weekend and see you Monday at 4!
