Jurisdiction:
In accordance with Zoning Bylaw section 103.4, the Design Review Authority is
authorized to review all commercial and mixed-use plans for projects south of Route 6
(the Jurisdiction).
Authority:
The Planning Board shall be the Design Review Authority for all projects in the Hotel
Motel Overlay District 2 (HMOD2), which is outlined in Zoning Bylaw section 404.2 and
for all projects submitted in conjunction with the Revitalization Overlay Architectural
District (R.O.A.D.) which is outlined in Zoning Bylaw section 411. The Design Review
Committee will submit its recommendations to the Planning Board.
The Design Review Committee shall be the Design Review Authority for all projects
within the Hotel Motel Overlay District 1 (HMOD1), as outlined in Zoning Bylaw section
404.1 and for all other commercial projects within the Jurisdiction.
Standards for Review:
All projects shall be reviewed for compliance set forth in the Yarmouth Architectural and
Site Design Standards (the Standards), as adopted and from time-to-time amended by
the Planning Board. Copies of the Standards are available at the office of the Town
Clerk or at the town’s website.
Projects located in the HMOD1, HMOD2 and those submitted as R.O.A.D. projects are
required to comply with the Standards. Where plans do not meet the Standards, the
applicant may apply separately to the Planning Board for relief in the form of a Special
Permit.
All other commercial projects within the Jurisdiction will be reviewed for general
compliance with the Standards, but comments shall be non-binding recommendations
and shall concern the conformity of the proposed actions with the objectives outlined in
the Zoning Bylaw section 103.4.3. Comments may include recommendations on such
items as landscaping, building style and craftsmanship, height and proportions, roof
shape and pitch, directional expression (orientation to street), relationship of building
and spaces, and other considerations as deemed appropriate by the Design Review
Committee.
REQUIRED APPLICATION REVIEW MATERIALS
For projects in the Hotel Motel Overlay District 2 (HMOD2) and for all projects submitted
in conjunction with the Revitalization Overlay Architectural District (R.O.A.D.), 13 copies
of the following materials shall be submitted with the Design Review application; For all
other projects within the Jurisdiction, 5 copies of the following materials shall be
submitted:
1.Site Plan: As outlined in Zoning Bylaw section 103.3.4. The plan must show the
location and dimension of the lot, the exact location and size of any existing or
proposed buildings or structures, streets and drives, curb cuts, parking, lighting,
signs, utilities, open spaces, and ways adjacent to the lot, existing and proposed
topography, drives, parking, landscaping, park or recreation areas, the use of
structures and land, screening, water, sanitary sewerage systems, storm drainage
systems, zone lines, and easements. In addition, plans shall show other features,
including but not limited to utility meters, AC condensers, on-ground transformers,
generators, disposal areas, vending machines and refrigeration units. Any and all
changes to the site of any kind must be shown. Such plans are to be prepared by a
registered architect or engineer. The site plan shall show the location and
dimension of the lot(s), the exact location and location of a proposed building or
structure and identifying existing buildings and structures, curb cuts, open spaces,
streetscape and roadways, parking, lighting, signs, utilities,.
The Site Plan is referenced in the following sections of the Design Standards:
Section 9, Landscaping; Section 10, Alternatives to the automobile; Section 11,
Accessibility; Section 12, Parking; Section 13, Utilities, and; Section 14, Outdoor
lighting.
Handicapped Accessibility – Any site plan is to include all requirements of the
Americans with Disabilities Act (ADA) and Massachusetts Architectural Board
regulations as well as conformance with the Town of Yarmouth Zoning Bylaws (301.
Parking and Loading) . Any new building, addition or reconstruction should include
proper siting and number, location and size of handicapped parking spaces and
proper handicapped accessibility (ramps, doorway sizes, elevator etc.).
Refer to Section11, Accessibility, in the Design Standards.
Utilities: – All on site utilities must be underground and so shown or noted on the
Site Plan.
Refer to Section 13, Utilities, in the Design Standards.
Exterior Lighting: exterior lighting should shown on the Site Plan or on a separate
Lighting Plan. Exterior lighting must be designed to provide sufficient light for
pedestrian and vehicle use without intruding beyond subject property limits onto
abutting properties. Lighting fixtures and posts should be in harmony with the
general architectural style of the proposed project and/or the surrounding
neighborhood and should not conflict with shade trees within landscaped islands.
The height of light posts should be in scale with the proposed and/or surrounding
structures.
Refer to Section 14, Outdoor Lighting, in the Design Standards.
2.Architectural Building Elevations: Four elevations, drawn to scale, of the
proposed building or structure to indicate the exact nature and extent of the
proposed project. Show dimensions of overall height from actual grade to ridge on
all four elevations.
Refer to Section 6, Architecture, in the Design Standards.
3.Landscaping Plan: A landscaping plan shall be part of all applications. All
applications are subject to all existing regulations within the Town of Yarmouth
Zoning Bylaws concerning buffers, tree planting, fencing and screening if and when
required. Trees should meet the minimum caliper requirements and all plantings
should be climate hardy and salt resistant for those trees planted by roadways.
Variations of species are preferred and a list of all plantings and their location is to
be included. A development plan should include location of sidewalks and walkways
and include a pleasing mixture of garden areas, shrubbery, perennial plantings,
sitting areas, etc. The plan should show the location of loading and disposal areas
and theses should be shielded from public view by vegetation and fencing as
feasible. Parking lots should be designed for ease of traffic flow, curb cuts minimized
and planting islands maximized to slow traffic and provide a pleasant visual buffer.
“In Lot” tree requirements are to be truly “in lot” and not along the periphery. Existing
vegetation should be incorporated into any development plan where it exists and the
site plan should include saving any important trees, landforms and view corridors
whenever possible.
In sum, the development plan should be designed to complement the building
design, to buffer the property with greenery and be deemed an overall attribute to
the community’s business environment
