Mr. Callahan,
Per our conversation dated 3/30/23, the following requirements must be met for
issuance of a permit to remove the sprinkler system at 9El Rt. 28. Based on the
change of use for the building and letter from Engineer Philbrook stating that a
sprinkler system is not required for the new use, and that replacement or repair of
said system. Yarmouth Fire Department will grant a permit for removal, provided
the following conditions are met:
l. Letter from owners' insurance company stating they are aware the system is
being removed.2. Yarmouth Water Department requires that the system is cut and capped at
the street. Please provide documentation that this will be done.3. AII Sprinkler piping, heads, connections, and risers are removed.4. A final inspection by YFD inspectors will be done prior to Use & Occupancy
being signed off.

Dear Mr. Grylss:
I am writing to provide a code review for the requirements tbr this buitding to have its' fire
suppression system removed. Presently the system is in default and in extreme disrepair. The
past current occupancy is A.2 [all-others] Restaurant. Adaptive plans call for a change of use 1o
B Business use through alterations & renovations- As proposed there will be no substantial
change to the buildings aspect ratios; floor area or story height. I have reviewed the IEBC 2015
code Work Area Compliance method Gotal building) Chp. 5 Sec. 504 Alterations (Level II) &
Chp. l0 Change of Occupancy. Both ofthese chapters have Fire Protection Sections.
Fire Protection: Paru.804.2.2 & Para. 1012.2.1 - Essentially both of these paragraphs refer the
need for sprinklers to the IBC 2015 Code for nerv construction. Pan.8M.2.2.l states that
sprinkler protection shall be IAW IBC 2015 for new construction (requirenrents). Pata- 1012.2.1
states that for change of occupancy sprinkler protection shall be based upon the new occupancy
IAW IBC 2015 for new construction. These referrals take usto Chp.9lBC2015 and more
specifically to Tbl. 903.2 (MA Amend) Occupancy Automatic Sprinkler Requirements.
New Use - B; based upon Tlb. 903.2 a sprilkler system is not required - No Ambulatory use.
Totsl area = 3,930 sf < 12,000 sf AND < 7,5fi) sq IAW M.G.L. c. 148,9 26G.
There are more construction requirements based on the IEBC 2015 for Change of Use. This
information is intended to specifically address the right to remove the fire suppression system.

Total area = 3,930 sf < 5,000 sf; Occupancy = 78 < 100; All on the level of exit discharge.

Carrier has confirmed as there is no specific warranty on the policy noting the sprinkler
system we are ok to keep the policy as is ( no issue with having the sprinkler system
removed and no changes needed at this time).
