The appeal must be filed within 10 days of the filing of the decision with Town Cleric

2. The Reason for this appeal is:
We attempted to go back to the Yarmouth Old King's Highway Committee with what we had
learned after the hearing but were told they would not hear us so we filed this appeal.
All six of our abutters, all with historic homes, display aluminum gutters. We will provide a
description of the importance of the homes and photographs of their gutters at the hearing.
The enabling legislation for the committees created a mandate to prevent alterations
that are "manifestly incongruous" with the historic aspects of the surroundings and the
immediate neighborhood. Forcing a single property owner to install fiberglass gutters when
surrounded by aluminum and where aluminum is the overwhelmingly dominant choice of
homeowners on the Old King's Highway and has become a visual fixture of its character
does not create a uniform historical landscape and treats our similarly situated home with
disparate enforcement.
B. Aluminum gutters are superior to fiberglass in many ways that are important to us in the
sense of form following function. The aluminum gutters would handle many times the
volume of water than fiberglass.Fiberglass gutters are more susceptible to leakage over
time.
The weight of fiberglass would create additional stress on the structure.
Our contractor, Everett Story, who has decades of experience in the installation of
aluminum gutters on historic homes on the Cape, will be available to answer any
questions members of the Commission may have.
