I’ve reviewed your proposal with the Conservation Administrator, please see my responses below: The single-car gravel parking spot on the opposite side of the house is approved. You can keep enough of the gravel driveway to park two cars side-by-side (roughly 10’), but it can’t go all the way to the fence, it needs to end at the front of the house. Unfortunately, the shed location in the corner next to the fence is still within 35’ of the wetland. It needs to be relocated. Anywhere on the opposite side of the house would be fine. To restore the disturbed area, you will need to do the following: Remove the remaining chopped wood and leaf piles. Relocate the shed and remove the excess gravel (as described above). Once the gravel is removed, that area will need to be restored by planting a minimum 10’ buffer of native plants along the wetland boundary. You will need to provide a planting plan showing the species and location to be planted. This can be a sketch plan, but it needs to be prepared or at least signed by a landscape professional. We will also need to see the new location of the shed and gravel areas either on that same landscape plan, or a separate sketch such as a mark-up of the septic plan. Let me know if you have any questions. If you agree to this outline, we’ll establish a rough timeline to follow-up on next steps. Below is the email I originally tried to send with some updates based on our phone call. Thank you for meeting with me on Monday, and for all the work you’ve done cleaning and moving the shed to begin to resolve the unpermitted work at your property. I have reviewed your septic plan (attached) to better advise you on the next steps. Unfortunately, it appears that the shed is still too close to the edge of the wetland as shown. If you can move it at least 35’ from the wetland without having to remove any vegetation, then we can approve it through the administrative review form we discussed on-site. If you want to wait until the septic work is done, it appears you would have room to move it over 100’ from the wetland which would require no approval from Conservation. Based on the septic plan almost the entire stone portion of the driveway is also within 35’. I’ve attached an image comparing the driveway as it appeared in April of this year and April of 2023 and I drew a rough highlight around the driveway expansion. It looks like it was added sometime between April 2023 and April 2024. You will either need to remove the stones in the highlighted area shown and then restore that area by planting a seed mix, or you may attempt to have that section of driveway permitted. Please note that it is very unlikely that the Commission would approve the driveway expansion within 35’ of the wetland. If you still decide to pursue this option, it will require hiring a professional to prepare surveyed site plans and file a Notice of Intent (NOI). This site plan is needed to accurately see how much of the driveway is in the buffer zone. I can provide more information and a list of consultants if you would like. I understand you want to discuss with your husband and look through your records to see if the gravel was pre-existing. Once you’ve done that please let us know what you decide. Let me know if you have any questions, and thanks again for your continued cooperation. Regards,Joe JerolimoConservation AgentTown of Yarmouthjjerolimo@yarmouth.ma.us508-398-2231 x7007
