Dear Member of the Yarmouth Conservation Commission,
Please accept this Request for a Certificate of Compliance (RCOC) on behalf of the Applicant, Steve
Hetzel, for the project authorized in the Order of Conditions (OOC) DEP File #SE83-2368 for the
completed work at 60 Bayberry Road, West Yarmouth (the Site). The project was issued OOC on
December 19, 2022, and was automatically granted a 2-year extension with the Mass Leads Act,
extending the expiration date of the OOC to December 19, 2027. The approved project consisted of
the construction of a single-family home. This project was completed in significant compliance with the
OOC and approved plan of record, dated September 27, 2022.
A few minor changes were made on the Site, which were not included in the project as permitted. The
first minor change includes the addition of a stone paver walkway leading from the road and driveway
to the front of the dwelling. These stone pavers are spaced out with grass in between, with a portion of
the paver walkway being located within FEMA Flood zone AE/Land Subject to Coastal Storm Flowage.
Additionally, the shell driveway was expanded to 20’ wide, from the originally approved 14’ wide
driveway. A portion of this expanded pervious driveway is located within FEMA Flood zone AE/LSCSF.
Finally, a wooden patio at grade was added to the rear of the dwelling, with a wooden 149 sf shed. The
nearby pervious paver patio was altered in size and location, and the rinse station was located to be
adjacent to the wood patio and wooden shed.
The Site has been fully stabilized, and a number of planting areas have been established around the
Site, including birch saplings and shrubs. Otherwise, all conditions listed in the OOC were abided by.

Administrative Checklist
Certificate of Compliance
General Information:
• All filings must be made on Town of Yarmouth forms.
• All applications must be submitted two weeks prior to the next scheduled Conservation
Commission meeting. Refer to Meeting Schedule.
• Failure to follow the Administrative Checklist shall result in an Administrative Incomplete
Application and will not be scheduled for a Public Hearing.
• Contact the Conservation Office if you need assistance.
Submitting an Application:
Hardcopy of the COC application mailed to or dropped off at the conservation Office
In Town Hall.
Signed statement from an Engineer or similar professional who prepared the
approved plan stating the date of a recent site inspection and certifying compliance
with the permit and outlining departures from the approved plan, if any exist.
If mitigation planting was required, include planting date and confirm the required
time has elapsed*.
As-Built plan meeting all Plan Requirements. – *Refer to the issued Order of
Conditions: Special Conditions to determine if an as-built is required*.
