NOTICE OF DEED RESTRICTION
RESIDENTIAL
Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 4 Rosetta Street , shown in Town Assessors Book dated 2015 , Map
28 , parcel 77 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 29027 , Page 284 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Plan of Lots at Hyannis Park” Situated in Yarmouth, MA for sale by John V. Scott,
Hayward and Hayward, C.E., Brockton, Mass.”, Lot 288 dated December, 1892 , and recorded on the Plan Book 26 Page 105 and Plan Book 216 Page 216-220.
The engineered plan prepared by Engineering Works, Inc. , dated April 15, 2015, approved by the Health Department on April 17, 2015 , requires a maximum, not to exceed:
(1) the number of bedrooms not to exceed One ( 1 ) per design restrictions,
(a) Title 5, Section 15.405 (1) (a), Maximum Feasible Compliance; Variance Granted for Setback Distance between Leach Facility and Property Line.
(b) Title 5, Section 15.405 (1) (b), Maximum Feasible Compliance; Variance Granted for Setback Distance between Leach Facility and Foundation.
(c) Title 5, Section 15.203, System Sewage Flow Design Criteria; Variance Granted to Allow a Minimum Design of Flow of Less than 330 gpd.
