HomeMy WebLinkAboutDeed Restriction Revised 6.8.07 NOTICE OF DEED RESTRICTION - REVISED RESIDENTIAL Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 7 Joanna Drive , shown in Town Assessors Book dated 2006 , Map 100 , Parcel 34 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 18269 , Page 148 . As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Subdivision Plan of Land in South Yarmouth, MA for Theodore Angelos, and Robert J. & Joseph A. Pocaro, Lot 13” dated January, 1966 , and recorded on the Plan Book 202 , Page 99 . The engineered septic design plan prepared by Sweester Engineering , dated December 30, 2003 , approved by the Health Department on February 23, 2004 , requires a maximum, not to exceed: (1) the number of bedrooms not to exceed Two ( 2 ); per design restrictions, Title V, Section 15.214, Nitrogen Loading Limitations, Zone II Areas of Wellhead Contribution. the removal of an existing MicroFAST® Unit 0.5 installed on July 30, 2004 is allowed per reconfiguration of the said property as shown on subdivision plan titled “Plan of Land in South Yarmouth, Massachusetts as prepared for Nicholas C. & Sandra L. White” by Sweetser Engineering, dated May 1, 2007, and recorded on the Plan Book 618, Page 21. Total square footage of said lots (13A and 13) being 20,000 S.F. will allow a maximum 2 bedrooms with a standard Title V septic system. Said lots 13A and 13 to be used contiguously to meet the minimum nitrogen loading standards of Title V, Section 15.214.
