Staff Present: Dolores Fallon PETITION 5243: Christopher and Angela Moniz, 3 Paula Lane, West Yarmouth, MA. Map & Lot #: 23.166; Zoning District: R-25. The Applicant seeks a Variance from Table 203.5 for front setback relief to construct a 12’ x 16’ shed. List of documents: Chris Moniz appeared at the hearing. Shed is proposed at the corner of Kerry Court and South Sea Avenue. Setbacks of 12 feet from Kerry Court, and 6 feet from the corner. Board Questions/Comments: Doesn’t appear to be anywhere else on the lot to place the shed. If shed placed at corner of Paula Lane and South Sea Avenue, it would be an obstruction. Six feet from the corner is too close to the street. Can the shed be pushed in? Currently 18 feet from the garage. Unique lot. Bounded by three streets: Paula Lane, South Sea Avenue, and Kerry Court. New Variance criteria of a “practical difficulty” related to site conditions. Shed on blocks? Pour a pad. Basement gets water. Not a lot of storage space in the house. If the Town wanted to expand the width of South Sea Avenue… Hardship is not self-created, no feasible alternative, septic system in the front yard. Move shed additional 4 feet from South Sea Avenue and at least 2 feet from Kerry Court. No public comments. A motion was made by Mr. Scali and seconded by Mr. Panebianco to continue the hearing to September 10, 2026. The members voted as follows: Mr. Martin-AYE; Mr. Scali-AYE; Mr. Panebianco-AYE; Chairman Igoe- AYE. The motion was voted 4-0 in favor. The petitioner signed an Extension Agreement. The petitioner needs to submit a drawing of the shed and an updated plan with the new distances from South Sea Avenue and Kerry Court.
