HomeMy WebLinkAboutVariance RequestsNotice of Intent Todd and Tilynn Wakefield, 23 Eriks Path, Yarmouth, MA VARIANCE REQUESTS Pursuant to Part 7, Section 7.01 of the Yarmouth Wetland Regulations, the Applicants request the following variances for the replacement of the existing licensed pier, ramp, and float and for the brick patio and walkway shown on the project plans. The proposed project includes bank restoration and native mitigation plantings as shown on the project plans. The work will maintain the existing licensed dock location, preserve the public- access area shown on the plans, and improve the vegetated buffer adjacent to the resource areas. DOCK WIDTH YARMOUTH WETLAND REGULATIONS 3.01(2) Yarmouth Wetland Regulations 3.01(2) limits rebuilt piers to a maximum width of four feet, measured inside pile to inside pile. The Applicants request a variance from the maximum dock-width requirement to allow the existing licensed pier to be replaced in kind within its existing location, as shown on the project plans. Reconstructing the pier in the location and configuration shown on the plans avoids establishing a new dock location. Construction access, staging, and equipment will be restricted as specified in the General Dock Notes. Therefore, the Applicants request that the variance be granted pursuant to Yarmouth Wetland Regulations Part 7. HEIGHT ABOVE SALT MARSH YARMOUTH WETLAND REGULATIONS 3.01(4) Yarmouth Wetland Regulations 3.01(4) requires rebuilt piers to achieve a minimum height-to- width ratio of 1.5:1 across the full extent of the structure overlying salt marsh, measured between the lowest horizontal stringer and the salt marsh. The Applicants request a variance from the required height-to-width ratio to allow the existing licensed pier to be replaced in kind and raised as shown on the project plans. The pier will be constructed with a minimum one-inch spacing between deck planks. Access will be from the Applicants’ property or a working barge, no barge will be located over the salt marsh, and no machinery or equipment will operate within the salt marsh. Therefore, the Applicants request that the variance be granted pursuant to Yarmouth Wetland Regulations Part 7. FLOAT DEPTH YARMOUTH WETLAND REGULATIONS 3.01(11) Notice of Intent Todd and Tilynn Wakefield, 23 Eriks Path, Yarmouth, MA Yarmouth Wetland Regulations 3.01(11) requires a minimum water depth at Mean Low Water of three feet on the seaward side of a float and 2.5 feet on the landward side. The project plans show a water depth of three feet at the seaward side of the float. The Applicants request a variance from the minimum landward-side float-depth requirement to allow the existing licensed float to be replaced in kind at the location shown on the project plans. Maintaining the existing licensed float location avoids establishing a new float location farther seaward. Therefore, the Applicants request that the variance be granted pursuant to Yarmouth Wetland Regulations Part 7. PATIO WITHIN THE NO-DISTURB BUFFER YARMOUTH WETLAND REGULATIONS 6.01(2) AND 6.02(1) Yarmouth Wetland Regulations 6.01(2) and 6.02(1) require a minimum 35-foot undisturbed natural vegetative buffer between projects and the identified wetland resource areas. The Applicants request a variance to allow the brick patio and walkway shown on the project plans, portions of which are located within the 35-foot no-disturb buffer. The patio and walkway are located adjacent to the existing dwelling in the area shown on the project plans. Removing or relocating the patio and walkway would not meet the project objective of maintaining the patio area adjacent to the dwelling. The project plans provide bank restoration and native mitigation plantings adjacent to the resource areas. Pursuant to Yarmouth Wetland Regulations 6.02(3)(c), the amount of mitigation associated with work within the 35-foot buffer will be subject to the Conservation Commission’s discretion. Therefore, the Applicants request that the variance be granted pursuant to Yarmouth Wetland Regulations Part 7.
