NOTICE OF DEED RESTRICTION
RESIDENTIAL
Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 26 Kerry Court , shown in Town Assessors Book dated 2016 , Map 23,
Parcel 164. As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 17614 , Page 222 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Plan of Land in West Yarmouth, Mass., Property of Clarence Y. Cotell” dated January,
1950, and recorded on the Plan Book 90 Page 135.
The engineered plan prepared by J.C. Engineering, Inc. , dated October 17, 2016 approved by the Health Department on November 14, 2016 , requires a maximum, not to exceed:
(1)the number of bedrooms not to exceed Two ( 2 ) per design restrictions,
(a) Title 5, Section 15.405, Maximum Feasible Compliance:
1. Setback Variance between Leach Facility/Septic Tank and Foundation
2. Adjusted Groundwater Variance
3. Setback Variance between Leach Facility/Septic Tank and Property Line
