Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 26 Lucerne Drive , shown in Town Assessors Book dated 2008 , Map
135 , parcel 84 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 10970 , Page 281 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Subdivision Plan of Land in Yarmouth, Mass. for Gerald P. McCarthy”, Lot 28 dated
April, 1969 , and recorded on the Plan Book 230 Page 139 .
The engineered plan prepared by Eagle Surveying, Inc. , dated December 10, 2008, approved by the Health Department on December 12, 2008 , requires a maximum, not to exceed:
(1) the number of bedrooms not to exceed Two ( 2 ) per design restrictions,
(a) Title 5, Section 15.203, Sewage Flow Design Criteria, and
(b) Title 5, Section 15.214, Nitrogen Loading Limitations
