Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 32 Appleby Road , shown in Town Assessors Book dated 2011 , Map
32 , parcel 142 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 3019 , Page 313 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Appleby Village West Yarmouth, Massachusetts, Property of Hudson R. & Leola R. Appleby,
E. H. Hinckley, Surveyor”, Inc., Lot 7 dated August, 1945 , and recorded on the Plan Book 71 Page117 .
The engineered plan prepared by R. J. Cadillac, R.S., P.L.S., P.C. , dated March 19, 2012, approved by the Health Department on March 20, 2012 , requires a maximum, not to
exceed:
(1) the number of bedrooms not to exceed Two ( 2 ) per design restrictions,
(a) Title 5, Section 15.405 (1) (h), Maximum Feasible Compliance; Variance Granted for Groundwater Separation between Leach Facility and Adjusted Groundwater.
(b) Title 5, Section 15.203 (2), System Sewage Flow Design Criteria: System Capacity designed for a Maximum Two Bedrooms.
