Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 38 McNamara Avenue , shown in Town Assessors Book dated 2013 , Map
66 , Parcel 66 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 18383 , Page 261 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Estate of Francis H. Behen, Half-Way Estates, Yarmouth, Mass., Scale 1”=40’, drawn
by Cape Cod Survey Consultants Inc., Iyanough Road (Route 132) Hyannis, Mass.” Lot 36 dated February 18, 1971, and recorded on the Plan Book 258 Page 3, 4, and 5.
The engineered plan prepared by Bass River Engineering , dated December 9, 2013 approved by the Health Department on December 24, 2013 , requires a maximum, not to exceed:
(1) the number of bedrooms not to exceed Two ( 2 ) per design restrictions,
(a) Title 5, Section 15.214, Nitrogen Loading Limitations
