Notice is hereby given of the applicability of the Town of Yarmouth Health Department for a deed restriction, to 39 Captain Stanley Road , shown in Town Assessors Book dated 2008
, Map 67 , parcel 151 . As Deed is recorded at the Barnstable County Registry of Deeds, on the Deed Book 10431 , Page 313 .
As plan of land is recorded at the Barnstable County Registry of Deeds on a subdivision plan titled “Subdivision Plan of a Portion of ‘Captains Village’, South Yarmouth, Mass., Thomas
E. Kelley, Surveyor”, Lot 408 dated December 17, 1970 , and recorded on the Plan Book 249 Page 111 .
The engineered plan prepared by Down Cape Engineering, Inc. , dated December 5, 2008, approved by the Health Department on January 12, 2009 , requires a maximum, not to
exceed:
(1) the number of bedrooms not to exceed Two ( 2 ) per design restrictions,
(a) Title 5, Section 15.405, Maximum Feasible Compliance, Groundwater Separation
(b) Title 5, Section 15.214, Nitrogen Loading Limitations
