We are considered to be pond front, south side of the house faces the pond.
Item 1. . We have a south facing retaining wall, built in the 90's that runs across the south side
of the house and is approx 110'from the pond. there are two oak trees that need work and
are located in the buffer zone iust below the retaining wall. One tree needs to be removed as it
is rotten at the base, the second tree has a limb that that needs to be removed. The concern

Upon further review it has been determined that all proposed work appears to be
outside of the 100' buffer zone and therefore exempt from Conservation regulation. I would still
recommend trimming rather than removal of the oak by the stairs, if possible, to maintain the integrity of
the slope. The retaining wall repairs will not require a permit from Conservation, but care should be
taken to prevent damage to the bank or habitat below the wall by installing a silt fence or straw wattle
south of the work area. Approved 9/9/2026
